MAYOR AND CITY COUNCIL <br />PAGE TWO <br />MAY 26, 1987 <br />City Attorney Meyers and I have reviewed the file <br />extensively and feel comfortable that the City would be able <br />to prevail in any lawsuit resulting from the denial of a <br />rezoning on the basis that the Comprehensive Land Use Plan <br />does not identify the property as being used for Highway <br />Commercial purposes which is the 83 zone and the current <br />zoning, 81, is in conformance with the Land Use Plan <br />designation. Attached is a copy of the District 1 portion <br />of the Comprehensive Land Use Plan relating to this site. <br />RECOMMENDATION: <br />Staff would recommend denial of the rezoning request for the <br />reasons outlined in the Planning Commission Resolution No. <br />182-87 adopted by the Planning Commission on May 6, 1987. <br />DFP/mjs <br />Attachments., <br />
