MEMO TO: MAYOR AND CITY COO 'IL <br />/' FROM: CLERK-ADMINISTRAT R <br />DATE: MAY 26, 1987 <br />SUBJECT: TOM THUMB FOOD STORE - 2408 COUNTY ROAD I <br />REQUEST FOR REZONING AND CONDITIONAL USE PERMIT <br />FOR THE SALE OF GASOLINE <br />Pump and Meter Service has filed an application with the <br />City for the rezoning of 2408 County Road I from Bl to B3 <br />and a Conditional Use Permit for the construction of a <br />self-service gas station. This issue was first considered <br />by the Mounds View Planning Commission in October of 1986, <br />copy of Staff Report and Proposed Resolution attached. The <br />Planning Commission at that time intended on adopting the <br />proposed resolution recommending denial of the rezoning on <br />the basis that the proposed use did not conform with the <br />Comprehensive Land Use Plan of the City and that the current <br />zoning on the property is in conformance with the Compre- <br />hensive Land Use Plan. The applicants withdrew their <br />request based on the determination by the Planning <br />Commission that they would deny the request and sought legal <br />counsel with respect to this matter. <br />The applicant reapplied for the rezoning and Conditional Use <br />Permit in March of 1987 on the basis that they would need to <br />have exhausted all possible administrative remedies prior to <br />seeking any legal remedies for their request for a <br />rezoning. The Planning Commission considered the <br />applicant's request and on May 6th adopted Resolution No. <br />182-87, copy attached, recommending denial of the rezoning <br />for the following reasons. <br />1. The proposed use did not conform with the <br />Comprehensive Land Use Plan. <br />2. The proposed use is inconsistent with the spirit <br />and intent of neighborhood commercial centers. <br />(Neighborhood Business District) <br />3. The site could not accomodate sufficient parking <br />because of the zoning ordinance for the proposed <br />use. <br />4. Spot zoning is strongly discouraged by land planning <br />authorities. <br />On May 14, 1987 the City received an appeal of the Planning <br />Commission's determination to recommend denial of the <br />rezoning and the application is now before you based upon <br />that appeal. <br />
