MEMO TO: PLANNING COMMISSIO <br />FROM: CLERK-ADMINISTRAT <br />' DATE: MAY 11, 1987 <br />CESSORY <br />SUBJECT: LARRY BUILDING ACONDITIONAL TUSE KPERMIT, MOUNDSHIGHWAY 10, VIEWPLANNING <br />CASE 209-87 <br />The applicant has requested a Conditional Use Permit to allow the <br />construction of a 400 square foot storage building, copy of site <br />plan attached, in addition to the construction of an 864 square <br />foot garage, a 448 square foot addition to the residence as well <br />as a 320 square foot porch to the residence. <br />Municipal Code 40.10, Subdivision C., 2. (c), provides that the <br />maximum size of an accessory building in an R1 District shall be <br />216 square feet unless a Conditional Use Permit is awarded by the <br />City. As the applicant requests approval for a 400 square foot <br />accessory building, a Conditional Use Permit will be required. <br />An analysis of the applicant's request indicates that the lot on <br />which the building will be constructed exceeds 2 acres in size, <br />the shed will be 15 feet from the closest sideyard, 26 feet from <br />the house and at .least 400 feet from the rearyard and no driveway <br />or other access will be available to the building. Based on <br />these observations it would appear that no negative impacts would <br />result from the approval of this Conditional Use Permit on any <br />adjacent property nor on the principle property itself. <br />Therefore, Staff would recommend Planning Commission recommend <br />approval of the Conditional Use Permit to the City Council which <br />will be required to hold a public hearing prior to taking action <br />on the Conditional Use Permit request which will require a 4/5's <br />approval of the full City Council. <br />DFP/mjs <br />Attachment: <br />
