1/20/88 <br />[REVISOR I EB/SS 88-3317 <br />• 1 disabled persons or organizations. <br />2 A prospective employer need not pay for an accommodation <br />3 for a job applicant if it is available from an alternative <br />4 source without cost to the employer or applicant. <br />5 (7)(a) Failure to complete a job evaluation system as set <br />6 out in section 471.994 by August 1, 1988, or failure to compile <br />7 the reports required under section 471.995 by August 1, 1988, <br />8 shall make any entity covered by sections 471.994 and 471.995 <br />9 ineligible to receive state funds of any kind either directly or <br />10 indirectly. The commissioner of the department of employee <br />.11 relations shall immediately notify the commissioner of human <br />12 rights of any entity not in compliance with section 471.994 or <br />13 471.995. If the commissioner of human rights has reason to <br />( 14 believe that an entity is not in compliance with section 471.994 <br />15 or 471.995, the commissioner shall notify that entity of its <br />15 potential noncompliance If the entity does not provide proof <br />17 to the commissioner of human rights that it is in compliance <br />18 with section 471.994 or 471.995 within ten days of receiving <br />19 notification, the commissioner of human rights shall notify the <br />20 entity and all state agencies that no state funds may either <br />21 directly or indirectly be received by said entity, <br />22 It is a misdemeanor for an employee of the state to allow <br />23 an entity the employee knows is not in compliance with section <br />24 471.994 or 471.995 to receive any state money. It is a 1 <br />25 misdemeanor for an employee of any entity not in compliance to <br />,26 facilitate in any way the receipt of state funds while the <br />27 employee knows the entity is not incompliance; <br />20 ;;� -- a g. nF hi,man richts may bring an action on <br />29 behalf of the state in district court to retrieve any mone-F paid <br />30 to any entity not in compliance with section 471.994 or <br />31 471.995. In the action, all funds paid to the entity since <br />32 August 1 1988, must be refunded to the state. If said entity <br />33 is found not in compliance with section 471.994 or 471.995 in <br />34 such an action, it shall be entitled to absolutely no funds or <br />35 payments from the state. <br />36 ,fib) Failure to have implemented the findings of the job <br />9 <br />
