1/20/88 (REVISOR ) EB/SS 68-3317 <br />1 evaluation system required by section 471.994 or 471.995 is a <br />2 prima facie showing of sex discrimination in all legal and <br />3 administrative hearings The showing may be rebutted only by <br />4 clear and convincing evidence presented by an employer that <br />5 proves that their pay scales are not discriminatory. <br />6 (c) If the commissioner of human rights believes a study <br />7 done under section 471.994 or 471.995 is invalid, the <br />8 commissioner may order that a new study be done by a firm chosen <br />9 by the commissioner of human rights The entity must cooperate <br />10 with the study. If the results of this study are at variance <br />11 with those of the entity's own study, the entity may adopt the <br />12findings of the new study, work out an agreement with the <br />13 commissioner of human rights as to w'at the findings will beg or <br />14 request a hearing before an administrative law judge to <br />15 determine what the appropriate findings will be. <br />16 Sec. 6. Minnesota Statutes 1986, section 363.03, <br />17 subdivision 2, is amended to read: <br />18 Subd. 2. (REAL PROPERTY.) It is an unfair discriminatory <br />19 practice: <br />20 (1) For an owner, lessee, sublessee, assignee, or managing <br />21 agent of, or other person having the right to sell, rent or <br />22 lease any real property, or any agent of any of these: <br />23 (a) to refuse to sell, rent, or lease or otherwise deny to <br />24 or withhold from any person or group of persons any real <br />25 property} because of race, color, creed, religion, national <br />26 origin, sex, maritzl status, status with regard to public <br />27 assistance, disability, or familial status; or <br />28 (b) to discriminate against any person or group of persons <br />29 because of race, color, creed, religion, national origin, sex, <br />30 marital status, status with regard to public assistance, <br />31 disability, or familial status in the terms, conditions or <br />32 privileges of the sale, rental or lease of any real property or <br />33 in the furnishing of facilities or services in connection <br />34 c,zcrewith, except that nothing in this clause shall be construed <br />35 to prohibit the adoption of reasonable rules intended to protect <br />36 the safety of minors in their use of the real property or any <br />r <br />L <br />LW <br />10 <br />
