thereto to qualify, or by reason of the death, resignation in writing filed with the city administrator, removal from office, non-residence in the city, conviction of a felony of any such person after their election, or by reason of the failure of any Council member without good cause to attend Council meetings for a period of three (3) consecutive months. In each such case the Council shall by resolution declare the vacancy to exist follow the appointment process in Chapter 4, Section 4.05. 2.02. Chapter 4 of the Mounds View City Charter is hereby amended by removing Section 4.05 in its entirety and replacing it with the following: Section 4.05 Vacancy in Municipal Elected Office Subdivision 1. Vacancy and 365 days or more remain in term. The following timelines shall be followed when addressing a vacancy in an elected office of the City that occurs with 365 days or more remaining in the term of the vacated office: A)A special election shall be called at the next uniform election date specified in Minnesota Statutes, section 205.10, subd. 3a, for which all legal requirements for special elections can be met by the City. [OPTION 1 – Recommended Language] B)The City Council shall appoint an individual following the appointment process in this Section 4.05 to fill the vacancy until a successor is elected and qualifies. [OPTION 2 – Language based on 2024 Proposal] B) If the date of the vacancy is more than 130 days from the date of the next eligible election the City Council must follow the appointment process in this Section 4.05 to fill the vacancy until a successor is elected and qualifies. No appointment may be made if the next eligible special election date is 130 or fewer days from the date of the vacancy. Subdivision 2. Vacancy and less than 365 days remain in the term. The following timelines shall be followed when addressing a vacancy in an elected office of the City that occurs with less than 365 days remaining in the term of the vacated office: [OPTION 1 – Recommended Language] A) The City Council shall appoint an individual following the appointment process in this Section 4.05 to fill the vacancy for the remainder of the unexpired term and until the election and qualification of a successor.
