City Council and <br />Planning Commission <br />May 31, 1988 <br />(Amended June 22, 1988) <br />Page 2 <br />The results of the survey are as follows: <br />1. Seventy-eight percent (35) of the cities do not have <br />wetland ordinances. <br />2. Eleven percent (5) of the cities (including Mounds View) <br />have wetland ordinances with minimum lot size, minimum <br />lot width, or minimum building setback requirements. <br />3. Eleven percent (5) of the cities have wetland ordinances <br />without minimum lot size, minimum lot width or minimum <br />building setback requirements. These cities generally <br />regulate wetlands by minimizing erosion, siltation and <br />pollution. <br />4. The Cities of Minnetonka a:,d Chanhassen are the only <br />other cities with a uinimum building setback from <br />vetlands and that distance is only 35 Zest and 75 feet, <br />respectively. The City of Mounds View's setback <br />distance is 100 feet and is 2.8 times greater than <br />Minnetonka's setback distance and 1.33 times greater <br />than Chanhassen's. <br />5. Moundp View is the only city Where the minimum lot width <br />for a single family residential lot in a wetland <br />district is wide_ than the minimum lot width for a <br />single family residential lot in a non -wetland district. <br />6. Cities directly adjacent to Mounds View do not have <br />watland ordinances. <br />7. Mounds View is the only city where phosphorus stripping <br />capacity is established by Ramsey Soil and Water <br />Conservation District. <br />In the City of Mounds View and in all other cities in the State <br />of Minnesota, wetlands are regulated by the Minnesota Dep; ,ment <br />of Natural Resourc=s (MnDNR), the U.S. Arvy Corps of Engineers <br />:CUE) and the respective watershed distr.c.ts or watershed <br />management boards. Of the cities surveyed, 78 percent rely <br />exclusively on outside agencies for watland regulation. <br />Based on the above survey information and the prohibition of <br />development on approximately 4.9 acres of land lying outside of <br />the wetland defined by the U.S. Army Corps of Engineers, we <br />strongly believe the City of Mounds View Wotlar.d Ordinance to be <br />overly restrictive.
