Item No: 08E <br /> MOUNDS VIEW Type <br /> Date: November s <br /> of Business: Council Business <br /> ss <br /> City Administrator Review: <br /> City or Mounds View Staff Report <br /> To: Honorable Mayor and City Council <br /> From: Jeremiah Anderson, Housing/Code Enforcement Inspector <br /> Item Title/Subject: Resolution 10170, Authorizing abatement of junk/hazards at <br /> 8391 Spring Lake Road <br /> Background: <br /> On January 27, 2025 the City Council approved resolution 10041 ordering abatement of <br /> hazardous conditions at 8391 Spring Lake Road. Staff performed follow-up inspections <br /> and the property owner completed the minimum necessary corrective actions and the <br /> matter was closed May 28, 2025. <br /> Introduction: <br /> In response to additional complaints, staff has once again investigated alleged outside <br /> junk/hazards located in the rear yard exterior of the property located at 8391 Spring <br /> Lake Road — Richard and Cindy Mitchell residence. Code Official Jeremiah Anderson <br /> inspected the property on August 21, 2025 and advised Mr. Mitchell that the outside <br /> storage at the property was in violation of the City Nuisance ordinance that he was <br /> previously notified of on numerous occasions. Code Official Anderson learned from Mr. <br /> Mitchell he was completing interior garage repair and moved items outside to provide <br /> access inside the attached garage. Additional personal contacts and follow up <br /> inspections have revealed that the garage project has stopped and cleanout of storage <br /> sheds on the property was occurring. <br /> Discussion: <br /> Code Official Anderson completed a follow up inspection at 8391 Spring Lake Rd on <br /> September 4, 2025 and issued a notice of violation #2025ECE-0273 regarding outside <br /> storage of items in violation of the City Nuisance code and established a date of <br /> September 23, 2025 for compliance. <br /> To date, outside storage of junk, debris, inoperable/unusable equipment, rusting metal <br /> remains outside in the rear yard at 8391 Spring Lake Road, thus continuing the ongoing <br /> pattern of outside storage of items in violation of the City Nuisance ordinance. <br /> A letter dated October 30, 2025 was sent to Richard Mitchell, the property owner at <br /> 8391 Spring Lake Road advising him the council would be taking action at their <br /> November 10, 2025, council meeting to move forward with abating the hazards. <br /> Council has three remedies to address the situation; abatement, civil penalties via <br /> Administrative Citation, and criminal charges. The abatement process gives staff legal <br /> authority to enter the property and remove the "junk" materials and assess all costs to the <br /> property owner. Failure to pay would result in assessment directly to the property. <br />
