Council can also direct staff to initiate a civil penalty with the City administrative citation <br /> for property-based violations. The 2025 fee schedule established a $150 penalty for <br /> property-based violations and a $300 penalty for the second offense withing 12 months. <br /> If Civil penalties remain unpaid the City has the ability to certify to them to the property <br /> taxes. Lastly, the Council could direct staff to initiate criminal charges which would occur <br /> through our prosecuting attorney. Ordinance violations are a misdemeanor under State <br /> Statute and have a maximum penalty of $750 and 90-days confinement, although staff <br /> experience is Ramsey County District Court sentence guidelines do not impose <br /> confinement, and penalties are generally minimum plus court costs totaling $150. <br /> Strategic Plan Strategy/Goal: <br /> A progressive city that is a welcoming and desirable destination to all ages and cultures, <br /> who seek progress through partnership, and a place where residents can live, work, and <br /> play safely and show pride in the community. <br /> Financial Impact: <br /> $1 ,000 to $2,000 in legal fees and clean-up fees. <br /> Recommendation: <br /> Adoption of Resolution 10170 will authorize staff to move forward with clean-up via <br /> abatement.
