City of Mounds View <br />Separation Ordinance Reporting Policy <br />Purpose <br />The City of Mounds View (the “City”) stewards its resources for the benefit of the public. This <br />stewardship of City resources is performed with care and responsibility as well as in <br />accordance with state public purpose expenditures law and in a nondiscriminatory fashion <br />compliant with both the Minnesota and United States Constitution. The City is committed <br />to serving all residents and visitors with dignity, respect, and fairness, and to fostering a safe, <br />welcoming, and inclusive community through the use of its public resources. <br />Scope <br />In furtherance of this purpose, the City Council of Mounds View adopted Ordinance no. <br />1056, creating Chapter 39 of the City Code. Section 39.03 of the City Code prohibits a City <br />employee or public official from allowing the use of city resources for the fo llowing purposes: <br />1) Enforcing federal immigration laws, except as authorized by law, a judicial <br />warrant, or other similar lawful authorization; <br />2) Discriminating against any individual on the basis of a protected class <br />characteristic; or <br />3) For personal benefit or profit. <br />City property may not be used or accessed by individuals or federal, state, or local agencies <br />for staging purposes, unless that use is authorized by a judicial warrant, subpoena, or other <br />similar lawful authorization. City property and resources are defined as under Chapter 39. <br />Section 39.04 requires that the City implement a process for the reporting of violations and <br />requests to use City property in violation of Section 39.03. The purpose of this policy is to set <br />forth that process and the requirements of those reports. <br />Policy <br />Pursuant to Section 39.04 of its Code, the City requires a written report be made recording <br />1) when City resources are identified or observed as being used for a prohibited purpose <br />under Section 39.03, and 2) when a request is made and denied for the use of City resources <br />for a purpose which is prohibited under that same section. <br />The report may be made in any reasonable and clear manner. It must include, at minimum, <br />the following information:
