The Mounds View Vision <br />A Thriving Desirable Community <br /> <br />Item No: _05D__ <br />Meeting Date: 06/22/2026 <br />Type of Business: ____Consent___ <br />City Administrator Review: _____ <br />City of Mounds View Staff Report <br />To: Honorable Mayor and City Council <br />From: Nyle Zikmund, City Administrator <br />Item Title/Subject: Resolution 10266, Adopting the City of Mounds View <br />Minnesota Government Data Practices Act Guidelines and <br />Procedures (aka Data Practices Policy) <br /> <br />Introduction: <br />Minnesota State Statues 13.025, Subd. 2, requires that Minnesota cities prepare a <br />written data access policy and update that policy each year, or more often as <br />necessary. <br /> <br />Discussion: <br />The Data Practices Policy was last updated in July of last year. As required by <br />Minnesota State Statutes, the policy must undergo an annual review and, if necessary, <br />revision. This year’s updates include minor date changes and several clarifying <br />language adjustments. There was also the addition of an entire paragraph in Chapter <br />3 (3.7), Access to Public Data. The draft 2026 policy is attached, with revisions <br />indicated in red (deletions) and blue (additions). <br /> <br />Here is a summary of the changes: <br /> <br />• Clarified what “explanation” means in Section 3.1. <br />• Added “or equivalent online form” to the references to Exhibit 3. <br />• Section 3.7 is new and responds to a recent legislative update that allows cities <br />to pause responding to a request if the responsible authority has made some <br />data available, but the requestor has not inspected data or collected copies. <br />• Clarified “six month” repeat request language to say that the city will not provide <br />data for the same request unless there is new data or a dispute. <br /> <br />Recommendation: <br />Staff recommends adopting Resolution 10266, a resolution approving the 2026 City <br />of Mounds View Minnesota Government Data Practices Act Guidelines and <br />Procedures (aka Data Practices Policy). <br /> <br />Respectfully submitted, <br /> <br />________________________ <br />Nyle Zikmund <br />City Administrator
