1 1) all three conditions required by statute to be satisfied affirmatively <br />before a variance can be granted, have been met with this proposal; <br />2) the fact that the restaurant is located on three streets seems to <br />justify the variance; <br />5 3) no neighborhood opposition to the variance was expressed to staff <br />6 prior to or after the Planning Commission August 16th hearing or <br />7 demonstrated during either that hearing or the Council's consideration <br />8 of the proposal, August 23rd. <br />9 Motion carried unanimously. <br />10 A_nolica: <br />11 Entrant <br />12 Signage <br />13 The Council agenda packet contained the same documents as had been <br />14 provided the Planning Commission with the addition of the floor plan and <br />15 elevations for the proposed restaurant building and a copy of the <br />16 minutes for the Council's December 5, 1985 meeting related to the sign <br />17 the Council had given the Hardee's Restaurant owner to erect a monument <br />18 sign on his property just north of Apache, which he had not erected to <br />19 date, preferring to keep the existing roof sign instead. <br />20 Proponents <br />William Sikora, Project Manager for the C. G. Rein Company and Dennis <br />z2 Cavanaugh, President of that company, were again present to seek <br />23 approval for a Burger King Restaurant to be erected in almost the same <br />24 location as the existing Sports and Health Club building on the north <br />25 side of Apache Mall as well as signage for the restaurant, which would <br />26 require a variance to the City's Sign Ordinance. <br />27 Mr. Sikora reiterated much of the information he had given the Planning <br />28 Commission, adding that the site plans had been redrawn to make the <br />29 changes suggested by the Planning Commissioners for rerouting traffic <br />30 flow from the drive up window in such a manner as not to interfere with <br />31 traffic on the adjacent north service road. A revised drawing of the <br />32 site with these changes incorporated was shown for the benefit of the <br />33 Council and residents of the townhomes directly across Silver Lake <br />34 Road. The plans included the suggested widening of the median east of <br />35 the drive-through lane to 25 feet and showed tall bushes and trees to <br />36 screen the call box and the parking lot adjacent to the site from the <br />37 Midwest Federal parking lot and the view of the residents in the <br />38 townhouses. Similar screening was indicated for the service road and <br />39 Equinox Apartments on the existing island running east and west which <br />40 had been extended as requested farther to the west for safer traffic <br />41 flow away from the drive -up window. <br />
