Pg. 2 <br />One of the neighbors, Mr. Tom Shaffer, who was present for another matter, was <br />questioned about the sentiment of the neighborhood about the structure and he <br />said that, though the neighbors were not happy with the appearance of -the <br />shelter, they had decided to wait until spring to indicate their dissatisfaction <br />to the owner. <br />The following action was taken by the Council after they had considered the <br />physical disability of the property owner: <br />Motion by Mayor Miedtke and seconded by Councilman Maik to direct the Manager to <br />write a letter to the property owner, James Marinan, advising him that the '. <br />Council is aware of the car shelter he has erected on his property at 2545 29th <br />Avenue M.E. which is in violation of the City Ordinance and will allow it to <br />remain there for only the remainder of the winter season but will now allow it <br />to be reconstructed next year. <br />Motion carried unanimously. <br />Mr. Richard Ernst, 2841 Johnson St. N.E. of the R.C.E. Corporation, was <br />present to receive the Council's decision regarding his request that part of <br />the Standard Oil property on the corner of Silver Lake Road and 37th Avenue M.F. <br />be replatted to allow the construction of a Country Kitchen Restaurant north <br />of the station. <br />The Manager reported that his contacts with the former mayor and councilmen who <br />had approved the platting of the property into one lot had indicated they <br />felt at that time this parcel, which was partially swamp, was not large enough <br />to adapt to any other use than the gas station and were concerned about <br />traffic congestion at that intersection. Councilman Sauer pointed out that <br />there is a sewer easement in force on the property which could affect the <br />placement of the restaurant. <br />Consideration was also given to the Attorney's opinion that the property west <br />of the station would have to be rezoned to C-2 for its use as a parking lot for <br />the restaurant as well as the reconstruction plans Ramsey County has for that <br />intersection and the opinion expressed by the county's highway department that <br />a curb cut on 37th Avenue M.E. would be necessary for the traffic to function <br />correctly. <br />Motion by Councilman Stauffer, seconded by Councilman Sauer to deny the Ernst <br />request to replat the north 117 feet of the lot owned by Standard Oil Station <br />at the N.W. corner of Silver Lake Road and 37th Avenue N.E. to accomodate the <br />construction of a Country Kitchen Restaurant basing their denial on the <br />following: <br />1. Necessity of rezoning the land west of the station on 37th Avenue <br />from Light Industrial to C-2 for which a similar request for the same <br />property had just recently been denied Mr. Ernst. <br />2. The possible hazardous congestion of the nearby intersection which <br />could result from the additional traffic generated by the restaurant. <br />Motion carried unanimously. <br />
