56 <br />November 25, 2014 <br />Page 4 <br />The uses currently located on the Property are generally of a low intensity use that does not <br />generate a significant amount of traffic on a daily basis. Both uses currently on site are also closed <br />on the weekend. <br />The proposed restaurant use is anticipated to generate 40-60 trips per day based on the Institute of <br />Traffic Engineers (ITE) Code . This number accounts for deliveries, garbage hauler pick-up, etc. Is <br />appears that both Kenzie Terrace and Lowry Avenue can adequately accommodate this anticipated <br />traffic. <br />Pedestrian Circulation <br />A sidewalk currently exists along Kenzie Terrace , with a connection to the north building on the <br />property as well as the parking lot to access the south building. A sidewalk also exists along the <br />north side of the south building where the Applicant is proposing the restaurant use . <br />Hours of Operation <br />The proposed hours of operation will be from 11am to 11pm Sunday through Thursday, and 11am <br />to lam Friday and Saturday . The Applicant has indicated the business's peak hours will be 6pm to <br />9pm seven days a week. The proposed hours are similar to other like-businesses within the area <br />(i.e . Village Pub). <br />Signage <br />The Property currently has a rooftop sign frame that the Applicant is proposing to reface. The sign is <br />56 sf in area (4'-Yi" x 14'-3 X") and is proposed to be an illuminated cabinet sign. <br />2. Applicable Codes Relating to Conditional Uses . <br />Title XV Land Usage, Chapter 152 Zoning Code, Section §152 .122 PERMITIED CONDITIONAL USES <br />(WITHIN THE C DISTRICT) (P) states that "Restaurants, cafeterias, and delicatessens located less than <br />250 feet from a residential structure or district" is permitted in the C District only by conditional use <br />permit issued by the City Council. <br />3. Criteria for, and Consistency with, Criteria for Conditional Use Permit (CUP) Approval. Title XV <br />Land Usage, Chapter 152 Zoning Code , Section §152 .243 CONDITIONAL USE PERMITS (C) Application <br />states that a conditional use permit may be granted only by a majority vote of all members of the <br />City Council after determining that: <br />1. The use is one of the conditional uses specifically listed for the district in which the property is <br />located; <br />The Property at 2510 Kenzie Terrace is located within the C-Commercial Zoning District, which <br />allows restaurants, cafeterias, and delicatessens located le ss than 250 feet from a residential <br />structure or district" as a permitted conditional use. Criteria met. <br />2. The City Council has specified all conditions which the City Council deems necessary to make the <br />use compatible with other uses in the area: <br />Conditions have been described in this report and are included in the draft resolution for <br />consideration . Criteria met. <br />Conditions include: <br />1. The Applicant shall submit the appropriate plans and permits for review and approval <br />before beginning any construction or other alterations that requires a permit (i.e . <br />building permit for any interior work, sign permit, electrical permit, plumbing permit, <br />etc .).
