The variance, if granted, would be consistent with the City's comprehensive land use plan. <br />If the variance is granted the use of the property would remain the same land use as it is today, <br />single-family residential. The comprehensive plan guides this area for single -family use and the <br />proposed addition will not alter that use . Criteria met. <br />4. The granting of the variance is in harmony with the general purposes and intent of the zoning <br />code. <br />The intent of the zoning code is to protect the health, safety, and general welfare of the city and <br />its people through the establishment of minimum regulations governing land development and <br />use . The zoning code is established to: <br />a. Protect the use districts; <br />The proposal would not change the use of the property or create a dis r uption to the <br />Single-Family Residential District. The current use (and proposed use) as a single-family <br />home is consistent with the City Code . Criteria met. <br />b. Promote orderly development and redevelopment; <br />The proposal seeks to make an improvement to the property by allowing the property <br />owners to construct a first story and basement addition to their existing home. The <br />proposed addition will not be detrimental to the neighboring property, nor will it <br />encroach further into the required side yard setback . The proposal also includes the <br />removal of a 7.4 foot wide impervious surface along the north property line, which is an <br />improvement to the area. Criteria met. <br />c. Provide adequate light, air, and access to property; <br />The proposal would not negatively impact adequate light or air from reaching the <br />property or adjacent properties. The proposed addition will be constructed on the east <br />end of the existing home, and is one-story above ground . The proposed addition will <br />not significantly encroach into the required side yard setback any more than existing <br />conditions, however it will nearly double the length of the structure that is <br />approximately 7 feet from the side lot line. This is not expected to negative ly impact the <br />neighboring residence to the north as the rear wall of the neighbor's home does not <br />extend as far east as the Applicant's existing home . Criteria met. <br />d. Prevent congestion in the public streets; <br />The proposal will have no impact on the amount of congestion in the public street. <br />Criteria met. <br />e. Prevent overcrowding of land and undue concentration of structures by regulating land, <br />buildings, yards, and densities; <br />Allowing the requested variance will not result in overcrowding of the land or an undue <br />concentration of structures. The addition, while nearly doubling the square footage of <br />the house, is not disproportionate to the area of the lot. Further, the addition will meet <br />the he ight, massing {FAR), and lot coverage requirements of the Zoning Ordinance . The <br />proposed addition will not significantly encroach into the required side yard setback any <br />more than existing conditions. Criteria met. <br />f Provide for compatibility of different land uses; <br />The proposal will not result in a change of land use , nor will it conflict with adjacent land <br />uses. Criteria met.
