Planning Commissioner Papatola stated the applicant has requested a conditional use permit 1 <br />amendment to expand the existing daycare facility to 5,000 square feet at 3055 Old Highway 8 2 <br />(St. Anthony Business Center) to be 5,000 square feet. Mr. Papatola reviewed the surrounding 3 <br />land use/zoning. He indicated the location of the property in a drawing. 4 <br /> 5 <br />Mr. Papatola provided an overview of the request: 6 <br />-Applicants wish to take on the Minnesota Education and Childcare Academy as a tenant as an 7 <br />after-school and summer childcare use. 8 <br />-Expansion of the existing daycare use from 2,370 sf to 5,260 sf. 9 <br />-Center would serve children ages 5-15 after school, weekends and limited summer hours for 10 <br />“drop in” care (2,890 sf addition). 11 <br />-Because the applicant is planning to expand the daycare use (which was previously granted a 12 <br />CUP), a CUP amendment is required. 13 <br /> 14 <br />CUP Criteria Review 15 <br />-The use is one of the conditional uses specifically listed for the district in which the property is 16 <br />located – Criterion met 17 <br />-The City Council has specified all conditions, which the City Council deems necessary to make 18 <br />the use compatible with other uses in the area; - Criterion met; Conditions include: Traffic 19 <br />control, Parking, Compliance with state and federal laws, Hours of operation. 20 <br /> 21 <br />Commissioner Brever asked if there was written verification from the State that no license is 22 <br />required. Mr. Casey suggested that could be added as a contingency to the approval. 23 <br /> 24 <br />Commissioner Stille noted the conditions are actually listed in the draft resolution. 25 <br /> 26 <br />Ms. Nicki Carlson, Building Manager stated there was an error in the presentation in terms of the 27 <br />square footage. The error was noted at the hearing to members of the Planning Commission and 28 <br />she had thought it had been corrected. Mayor Faust stated he is hesitant due to the fact the actual 29 <br />sf amount is not known by the applicant before going forward. Mr. Casey stated the application 30 <br />would need to be extended 60 days. 31 <br /> 32 <br />Ms. Nicki Carlson stated the correct information is that the new proposed childcare has 5,260 sf. 33 <br />The existing daycare has 2,370 sf. The original presentation made by the City Planner listed the 34 <br />5,260 sf as the total. 35 <br /> 36 <br />Councilmember Gray stated in the memorandum from the City Planner that the proposed 37 <br />childcare added to the existing daycare would be 5,260 sf. 38 <br /> 39 <br />Mayor Faust referred to page 45 of the Council packet. Corrections were made to the draft 40 <br />Resolution No. 15-048 “request to expand the square footage of the daycare facilities to an 41 <br />additional of 5,260 sf for a total of 7,630 sf, as outlined in the floor plan in Exhibit B.” 42 <br /> 43 <br />Possible actions for the City Council are as follows: 44 <br /> 45 <br />1. Adopt a resolution, which approves the Conditional Use Permit Amendment. The City 46 <br />Council may modify the draft resolution for approval to include any conditions it deems 47 <br />necessary. 48 <br />33
