COOPERATIVE AGREEMENT <br /> <br />For the St. Anthony Stormwater Treatment and Research Facility <br /> <br /> This Cooperative Agreement is made on this ___ day of __________, 2015, by and <br />between the City of Minneapolis (hereinafter referred to as "Minneapolis") a Minnesota home <br />rule charter city pursuant to the laws and Constitution of the State of Minnesota; the City of St. <br />Anthony Village (hereinafter referred to as "City of St. Anthony ") a Minnesota home <br />rule/statutory city pursuant to the Constitution and laws of the State of Minnesota. <br /> <br />Recitals and Statement of Purpose <br /> <br /> <br /> WHEREAS, the facility that is the subject of this agreement will provide treatment of <br />stormwater runoff from the City of St. Anthony prior to discharge into the City of Minneapolis <br />storm sewer system and the Mississippi River as shown in the attached appendix; and, <br /> <br /> WHEREAS, this facility is intended to frequently change treatment processes to provide <br />research of emerging stormwater technologies to improve the quality of stormwater discharged <br />from urban land uses; and, <br /> <br />WHEREAS, the location and dimension of the research facility is shown in the attached <br />exhibit; and, <br /> <br /> WHEREAS, the proposed project location is outside the St. Anthony City limits, but <br />within the limits of the City of Minneapolis; and, <br /> <br /> WHEREAS, the City of Minneapolis will transfer ownership of that segment of storm <br />sewer located from the southernmost manhole of the treatment structure to the municipal <br />boundary to the City of St. Anthony: and, <br /> <br /> WHEREAS, the treatment site is located on Hennepin County right-of-way in the City of <br />Minneapolis. <br /> <br /> NOW, THEREFORE, IT IS MUTUALLY AGREED by and between the parties that <br />they enter into this Cooperative Agreement in order to document the understanding of the parties <br />as to the scope of the entire project; reaffirm the commitment of each party as to the general <br />responsibilities and tasks to be undertaken by each party; establish procedures for performing <br />these tasks and responsibilities; and facilitate communication and cooperation among the parties <br />to ensure successful completion of the project, in order to achieve the ultimate goal of improving <br />water quality in the Mississippi River. <br />132
