52 <br /> • "Project Area" means the area designated for redevelopment by the HRA pursuant to the <br /> Redevelopment Plan and the Act. <br /> "Public Redevelopment Costs" means costs described in Minnesota Statutes, Section 469.176, <br /> subdivision 4j and includes those incurred for: (a) reimbursement to the Redeveloper of any Acquisition <br /> Costs paid to unrelated third parties by the Redeveloper for Redevelopment Property; (b) demolition <br /> and site development costs related to the Project; and(c) costs of the Storm Sewer Improvements. <br /> "PUD Agreement" means the Planned Unit Development Agreement dated as of , 2000 <br /> between the City and the Redeveloper, together with any supplement or amendment thereto. <br /> "Redeveloper" means Hillcrest Development, a Minnesota limited partnership. <br /> "Redevelopment Plan" means the Redevelopment Plan approved by the City on August 25, 1992, as <br /> amended by amendments thereto dated March 23, 1993 and August 22, 2000. <br /> "Redevelopment Property" means the portion of the Project Area described on Schedule A attached <br /> hereto. <br /> "Restrictions" means the easements, covenants, conditions and restrictions set forth in Exhibit B. <br /> • "Section" means a Section of this Agreement, unless used in reference to Minnesota Statutes. <br /> "State" means the State of Minnesota. <br /> "Storm Sewer Improvements" means the Storm Sewer Improvements to be undertaken by <br /> Redeveloper as a part of the Project all as further described in Schedule B attached to this Agreement. <br /> "Tax Increment Act" means Minnesota Statutes, Sections 469.174 through 469.179. <br /> "Tax Increment District" means Tax Increment District No. 5-Ramsey County created by the HRA <br /> pursuant to the Tax Increment Financing Plan. <br /> "Tax Increment Financing Plan" means Tax Increment Financing Plan for Tax Increment Financing <br /> District No. 5-Ramsey County approved by the HRA and the City Council and dated August 22, <br /> 2000. <br /> "Unavoidable Delay" means a failure or delay in a party's performance of its obligations under this <br /> Agreement,or during any cure period specified in this Agreement which does not entail the mere <br /> payment of money, not within the party's reasonable control, including but not limited to acts of God, <br /> governmental agencies, the other party, strikes, labor disputes (except disputes which could be <br /> • <br /> -4- <br />
