AGREEMENT <br /> • AGREEMENT, made and entered into this 1st day of January, 1987, by <br /> and between LAKE ANIMAL CARE, INC. , hereinafter referred to as "LAKE" and <br /> the CITY OF ST. ANTHONY, a municipal corporation, counties of Hennepin <br /> and Ramsey, State of Minnesota, hereinafter referred to as "CITY/TOWN" . <br /> WITNESSETH: That LAKE, in consideration of the covenants and <br /> agreements of CITY/TOWN hereinafter contained, hereby covenants with <br /> CITY/TOWN that LAKE will provide Animal Control Service to CITY/TOWN <br /> pursuant to the following provisions: <br /> 1. That LAKE shall pick up animals found in violation of <br /> CITY/TOWN ' s ordinances in a vehicle appropriate for the <br /> transportation of small animals. Patrol service shall be <br /> provided in accordance with a schedule mutually agreed <br /> upon by the parties hereto. Standby call-out service <br /> shall be provided on a twenty-four (24) hour basis at the <br /> specific request of CITY/TOWN ' S law enforcement agency <br /> and/or a previously specified official of CITY/TOWN. <br /> 2. Lake agrees that patrolling shall be done by competent <br /> personnel trained in the handling of animals. That such <br /> 1:1r'•►":;:"1111(:. Employees shall be authorized by <br /> the CITY/TOWN to apprehend and retain dogs , cats, and <br /> other animals, which are in violation of the CITY/TOWN <br /> • Ordinance. However, Lake will not invade the private <br /> property contrary to the wishes of the owner of said <br /> property nor forcibly take an animal from any person <br /> without the approval and assistance of a' regular officer <br /> of the City/TOWN. <br /> 3. That LAKE shall equip, service and maintain all vehicles <br /> used for Animal Control Service with two-way radios or <br /> other communication. <br /> 4. Pursuant to Minnesota Statute 35. 71, LAKE shall impound <br /> all animals picked up in CITY/TOWN at its Animal Shelter <br /> located at 10911 Raddison Road, Blaine Minnesota or 1283 <br /> Hammond Road, White Bear Township Minnesota. Said <br /> animals shall be confined in a humane manner for a period <br /> of not less than five (5) business days or until claimed <br /> by an owner. Animals not claimed before the expiration <br /> of five (5) business days shall become the property of <br /> LAKE . That all impoundment fees shall be returned by LAKE to <br /> CITY/TOWN. <br /> 6 . That euthanasia service provided by LAKE shall be <br /> • administered by qualified personnel and the disposal of <br /> animal carcasses shall be performed as required by <br /> Minnesota Statute Section 35. 82, Subd. 2 (a) . <br />
