the inclusion of these provisions in every subcontract entered
<br /> into by any of its contractors, unless exempted by rules ,
<br /> regulations, or orders of the Secretary of Labor issued
<br /> pursuant to Section 204 of Executive Order 11246 of
<br /> September 24 , 1965, so that such provisions will be binding
<br /> upon each such contractor, subcontractor, or vendor, as the
<br /> case may be. Redeveloper will take such action with respect to
<br /> any construction contract, subcontract, or purchase order as
<br /> the HRA may direct as a lawful means of enforcing such
<br /> provisions, including sanctions for noncompliance; provided,
<br /> however, that in the event Redeveloper becomes involved in, or
<br /> is threatened with, litigation with a subcontractor or vendor
<br /> as a result of such direction by the HRA, Redeveloper may not
<br /> request to involve the HRA.
<br /> Section 10 . 3 Restrictions on Use . Redeveloper agrees
<br /> for itself , and its successors and assigns , and every successor
<br /> in interest to the Redevelopment Property, or any part thereof ,
<br /> that Redeveloper, and such successors and assigns , shall devote

<br /> with, the uses specified in the Redevelopment Plan and this
<br /> Agreement, and shall not discriminate upon the basis of race,
<br /> color, creed, sex or national origin in .the sale, lease, or
<br /> rental or in the use or occupancy of the Redevelopment Property
<br /> or any improvements erected or to be erected thereon, or any
<br /> part thereof .
<br /> Section 10 .4 Provisions Not Merged With Deed. None
<br /> of the provisions of this Agreement are intended to or shall be
<br /> merged by reason of the Deed and the Deed shall not be deemed
<br /> to affect . or impair the provisions and covenants of this
<br /> Agreement .
<br /> Section 10 . 5 Titles of Articles and Sections . Any
<br /> titles of the several parts, Articles, and Sections of this
<br /> Agreement are inserted for convenience of reference only and
<br /> shall be disregarded in construing or interpreting any of its
<br /> provisions .
<br /> Section 10 . 6 Notices and Demands . Except as
<br /> otherwise expressly provided in this Agreement, a notice,
<br /> demand, or other communication under this Agreement by either
<br /> party to the other shall be sufficiently given or delivered if
<br /> it is dispatched by registered or certified mail , postage
<br /> prepaid, return receipt requested, or delivered personally; and
<br /> (a) in the case of Redeveloper, addressed to or
<br /> delivered personally to Redeveloper at 4601 Excelsior
<br /> Boulevard, Suite 651, Minneapolis , Minnesota 55416 , Attention:
<br /> Francis W. Lang, with copy to Stephen Davis, 3910 Multifoods
<br /> Tower, 33 South 6th Street, Minneapolis, Minnesota 55402 .
