10 . Parking lots shall be built only in accordance with the <br /> Plan and shall be maintained with a dust-free asphalt <br /> surface and include raised concrete islands at the ends of <br /> each row of parking to define the circulation and protect <br /> the parking area . The islands shall be at least 6 inches <br /> high and constructed of concrete. <br /> 11 . Benches and bus shelters, if any, specified in the Plan <br /> shall be maintained in a good, safe, clean- and attractive <br /> condition. <br /> 12 . All buildings, parking areas, open areas , landscaped areas, <br /> and other improvements (collectively, the "Improvements" ) <br /> on the Property shall be maintained in a good, safe, clean <br /> and attractive condition. If any of the Improvements are <br /> damaged or destroyed by fire, storm or by any other means, <br /> they shall be restored or rebuilt in accordance with the <br /> Plan to a condition and value equal to or greater than <br /> their condition and value on the date of the destruction or <br /> damage. <br /> 13 . All buildings on the Property shall be insured against all <br /> loss or damage in the amount of the full replacement value <br /> thereof, with a policy or policies of insurance which <br /> provide protection against all perils covered by the <br /> customary fire., extended coverage, vandalism, malicious • <br /> mischief , or, so-called "all-risk" policy of insurance. <br /> 14 . So long as any bonds issued by the City of St . Anthony or <br /> its Housing and Redevelopment Authority in connection with <br /> Redevelopment of the Property are outstanding, no owner, <br /> tenant, purchaser or other person having an interest in the <br /> Property shall seek administrative or judicial review of <br /> any statute, law, rule, assessor ' s estimated market value, <br /> assessed value, or other factor, which would or might <br /> result in real estate taxes on the Property being <br /> insufficient in any year to pay the principal and interest <br /> on said bonds as it becomes due. <br /> 15 . The covenants and restrictions herein contained shall run <br /> with the title to the Property and shall be binding upon <br /> all present and future owners and occupants of the <br /> Property; provided, however, that the covenants and <br /> restrictions herein contained shall inure only to the <br /> benefit of the Housing and Redevelopment Authority of St . <br /> Anthony, Minnesota ( "HRA" ) , and may be released or waived <br /> in whole or in part at any time, and from time to time, by <br /> the sole act of the HRA, and variances may be granted to <br /> the covenants and restrictions herein contained by the sole <br /> act of the HRA.
