1 feet from grade to highest roof peak level , where 42 feet had previously <br /> 2 been approved and the Zoning Ordinance only allows 35 feet heights. <br /> •3 As recommended by the Planning Commission, the approval is subject to: <br /> 4 *platting the property as required by Ordinance; <br /> 5 *provision of 206 underground and 153 surface parking spaces on the <br /> 6 site; <br /> 7 *ponding for aesthetic and storm drainage purposes as indicated on <br /> 8 the Site Plan; <br /> 9 *brick exteriors with wood accents around the balconies or extended <br /> 10 living room areas proposed by the developer; <br /> 11 *a peak rather than flat roof design; <br /> 12 *no vehicular access from Lowry Avenue N.E. ; <br /> 13 *landscaping, vegetation, and bermed screening as shown in the <br /> 14 Preliminary Landscaping Plan; <br /> 15 *provision of a walkway to the shopping center areas as well as <br /> 16 - access to the site for emergency vehicles; and <br /> 17 *consideration given to security for the ponding areas as well as <br /> 18 consideration of a walking path for residents around the site <br /> 19 perimeters. <br /> 20 In approving these amendments the Council waives the required 2% bonding <br /> 21- and finds that neighbor concerns about the proposal appear to have been <br /> 22 satisfied because no one appeared to speak against the proposal during <br /> 23 the Council's consideration of Lang-Nelson's proposal. <br /> 24 Motion carried unanimously. <br /> �5 Variance Granted for Mew Signage on TA's Family Restaurant at 2905 <br /> 26 Kenzie Terrace <br /> 27 Councilmember Ranallo told Tom Rose, the restaurant owner's spokesman, <br /> 28 that he considered a 12 foot, variance to the City Sign Ordinance <br /> 29 requirements a good tradeoff to get rid of the "tall monstrosity" on the <br /> 30 roof now. Mr. Rose reconfirmed that Mr. Aulwes intended to remove the <br /> 31 existing roof sign on the building right away. <br /> 32 Council Action <br /> 33 Motion by Enrooth, seconded by Ranallo to grant the request from Thomas <br /> 34 J. Aulwes for variance to the City code to allow two signs, 56 square <br /> 35 feet each ( 112 square feet total) on the TA's Family Restaurant at 2905 <br /> 36 Kenzie Terrace where the City Ordinance only allows one sign of up to <br /> 37 100 square feet, for that building. As a condition for granting the <br /> 38 variance, the owner is required to remove the existing roof sign on the <br /> 39 building as he had stated would be done in his July 27 , 1988 petition <br /> 40 for a Sign Variance. <br /> 41 In granting the variance, the Council finds, as did the Planning <br /> 42 Commission, that: <br /> 5 <br /> • <br />
