13 <br /> 1 he would construct a new driveway for them in exchange for their <br /> 2 releasing the agreement, but the neighbor on the other side had to agree <br /> 3 to that as well. <br /> 4 No one else spoke to the issue and the Chair closed the hearing at 9:04 <br /> 5 P.M. for development of the following motion: <br /> 6 Commission Recommendation <br /> 7 Motion by Brownell, seconded by Hansen to recommend the City Council <br /> 8 grant the variance requested by Edward Hance which would allow garage <br /> 9 construction at 2813 Silver Lane within a minimum of 13 feet from the <br /> 10 front property line in accordance with the architect's October 11, 1988 <br /> 11 site and elevation drawings in the Planning Commission's November 15th <br /> 12 agenda packet. In recommending the variance be granted, the Commission <br /> 13 finds that the applicant had satisfactorily addressed the three <br /> 14 requirements for granting a variance and a hardship had been created <br /> 15 for the applicant by the strict regulations of the Rice Creek Watershed <br /> 16 District requiring a substantial' (57 feet according to Mr. Hance) <br /> 17 setback from Silver Lake. <br /> 18 Motion carried unanimously. <br /> 19 Junk Yard Appearance of Property in Same Area Concerns Commissioner <br /> 20 Madden <br /> 21 The Commissioner wondered if the owner of property just down from Mr. <br /> 22 Hance might not be operating a junk yard from his home because he had <br /> 23 seen car batteries piled high in the yard which he assumed was in <br /> 24 violation of not only the City Ordinances but also environmental <br /> 25 pollution regulations. The Assistant to the City Manager told him she <br /> 26 knew this was a problem staff was working on already, but promised to <br /> 27 make a note to find out more about it from Mr. Hamer. <br /> 28 At 9:10 P.M. the Chair opened the public hearings scheduled to consider <br /> 29 , revisions in the Development Concept Plan and Detail Plan for approval <br /> 30 under the Planned Unit Development for the construction of a 201 unit <br /> 31 apartment complex on the former St. Anthony Village Shopping Center <br /> 32 property which the developers have now named Kenzington Apartments of <br /> 33 St. Anthony. The developers, LaNel Financial Group, Inc. had also <br /> 34 requested a waiver of the Preliminary Plat and approval of the Final <br /> 35 Plat of the project property. Because of its length, as well as the <br /> 36 fact that the- Commissioners would be acting on the information covered <br /> 37 in the Notices of the Hearings which had been published in the <br /> 38 November 2, 1988 Bulletin, the Chair , with the concurrence of the rest <br /> 39 of the Commissioners, did not read the documents aloud. <br /> 40 Copies of the notices had been mailed to all property owners of record <br /> 41 within 350 feet of the subject property along with copies of the most <br /> 42 current plans. No one reported failure to receive this documentation <br /> 43 or objected to its content. <br />
