He described ponding in his <br /> 8 yard, Ms . Clarke' s lot , and all the way to the culvert . Mr . <br /> 9 Bulthaus reiterated that his concern was with the existing <br /> 10 drainage problem in the area and not with Ms . Clarke <br /> 11 proposed porch. <br /> 12 <br /> 13 Chairman Madden invited Ms. Clarke to make any further <br /> 14 comments she might wish to make . Ms. Clarke stated that the <br /> 15 house will be properly constructed and will be an asset to <br /> 16 the neighborhood. She said that a similar porch has already <br /> 17 been constructed in her neighborhood, and that hers will <br /> 18 harmonize with that existing structure . Commissioner Wagner <br /> 19 asked Ms . Clarke whether that porch exceeds the setback <br /> 20 requirement , but Ms. Clarke aid not know. She pointed out <br /> 21 that the house directly behind her lot was granted a rear <br /> 22 yard setback variance , but Commissioner Wagner replied that <br /> • 23 that variance had been granted because of tornado damage . <br /> 24 Ms. Clarke then distributed to the Commission copies of <br /> 25 letters from three supportive neighbors . <br /> 26 <br /> 27 The hearing was closed at 8 : 16 p.m. for Commission <br /> 28 consideration of a recommendation. <br /> 29 <br /> 30 Commissioner Werenicz stated that the applicant ' s request <br /> 31 does not meet all three statutory requirements for a <br /> 32 variance . He felt that her request was due to financial or <br /> 33 personal hardship and that feasible alternatives had not <br /> 34 been fully explored by the applicant . Chairman Madden <br /> 35 expressed doubts about the wisdom of permitting a structure <br /> 36 to be built in a swale . Commissioner Faust again commended <br /> 37 Ms. Clarke for approaching the Commission with her proposal , <br /> 38 but agreed that the three statutory requirements for <br /> 39 variances were not met. Commissioner Hansen expressed his <br /> 40 agreement with the Commissioners who had spoken before him, <br /> 41 and reasoned that the house simply didn ' t fit the lot . <br /> 42 Commissioner Brownell cautioned the Commission against <br /> 43 recommending a variance for future , speculative <br /> 44 construction. Chairman Madden reminded the Commission that <br /> 45 Council denial of the request would not preclude Ms. Clarke <br /> 46 from returning to the Commission at some future date to make <br /> 47 a similar request with more definite plans . <br /> • 48 <br /> 49 Motion by Brownell , seconded by Wagner , to recommend <br /> 50 that the City Council deny the setback variance request by <br />
