• CITY OF ST. ANTHONY <br /> ORDINANCE 1992-007 <br /> AN ORDINANCE RELATING TO THE CONSTRUCTION, RECONSTRUCTION, <br /> REPAIR AND IMPROVEMENT OF STORM SEWER SYSTEMS AND <br /> RELATED FACILITIES AND CHARGES FOR THE USE AND AVAILABILITY <br /> OF STORM WATER FACILITIES; AMENDING THE ST. ANTHONY 1973 <br /> CODE OF ORDINANCES BY ADDING A NEW SECTION 260 <br /> The City Council of the City of St. Anthony hereby ordains: <br /> Section 1. The St. Anthony 1973 Code of Ordinances is amended to add a new <br /> Section 260 to read as follows: <br /> Section 260 - STORM WATER FACILITIES AND CHARGES <br /> 260.00. Establishment of Storm Water Facilities Fund. Pursuant to Minn. Stat. § <br /> 444.075, the City establishes a storm water facilities fund and authorizes the <br /> imposition of just and equitable charges for the use and availability of storm sewer <br /> facilities. For purposes of this Section 260, all provisions of Minn. Stat. § 444.075 <br /> • relating to storm water facilities are incorporated by reference and are made a part of <br /> this Section. <br /> 260.05. Findings and Determinations. <br /> Subd. 1. In the exercise of its governmental authority and in order to <br /> promote the public health, safety, convenience and general welfare, the City <br /> has constructed, operated and maintained a storm sewer system, including <br /> mains, holding areas and ponds, and other appurtenances and related <br /> facilities (the "facilities"). This Section 260 is adopted in the further exercise <br /> of such authority in the future, for the same purposes, and for purposes of <br /> financing the cost of building, constructing, reconstructing, repairing, <br /> operating, maintaining, enlarging, improving or in any other manner <br /> obtaining, the facilities or any portion of them (the "facilities costs"). <br /> Subd. 2. The facilities have heretofore been financed and paid for through the <br /> imposition of special assessments and ad valorem taxes. It is now necessary <br /> and desirable to provide an alternative method of recovering some or all of <br /> the future facilities costs through the imposition of charges as provided in <br /> this Section. <br /> Subd. 3. In imposing charges for the facilities ("facilities charges"), it is <br /> • necessary to establish a procedure designed to make the charges just and <br />
