Other land uses not listed in the table in Section 260.10 <br /> will be classified by the Director of Public Works by assigning them to classes most <br /> nearly like the listed uses from the standpoint of runoff volume for the standard <br /> rainfall event. An appeal from the Director of Public Work's determination of the <br /> property classification may be made to the City Council. <br /> 260.20. Exemptions. The following land uses are exempt from facilities charges: (a) <br /> City, County and State road and highway rights-of-way,.(b) lakes and ponds, and (c) <br /> City-owned property. <br /> 260.25. Seyarate Fund. All facilities charges, when collected, and all moneys <br /> received from the sale of any facilities or equipment or any by-products, will be <br /> placed in a separate fund, and used.first to pay the normal, reasonable and current <br /> costs of operating and maintaining the facilities. The net revenues received in <br /> excess of the costs may be pledged by resolutions of the Council, or may be used <br /> though not so pledged, for the payment of principal and interest on obligations <br /> issued as provided in subdivision 2, of Minn. Stat. § 444.075, or to pay the portion of <br /> the principal and interest as may be directed in the resolutions. <br /> 260.30. Adjustment of Charges. The City Council may by ordinance adopt policies <br /> providing for the adjustment of facilities charges for parcels or groups of parcels, <br /> based upon land use data supplied by affected property owners, which data <br /> demonstrates a runoff volume for the standard rainfall event substantially different <br /> from the REF being used for the parcel or parcels. Such adjustment will be made <br /> only upon recommendation of the director of Public Works and will not be made <br /> effective retroactively. <br /> 260.35. Public Hearing and Notice. The City will hold a hearing prior to <br /> determining whether to build, construct, enlarge or improve facilities financed in <br /> whole or in part by the imposition of facility charges. Notice of such hearing will be <br /> published in the official City newspaper at least 10 days prior to the date of hearing. <br /> Owners of all property adjoining a proposed improvement will be mailed or served <br /> with a notice at least 10 days in advance of the hearing. Failure to give mailed <br /> notice or any defects in the notice will not invalidate the proceedings. <br /> 260.40. Establishment of a Tax Lien. Any facilities charges in excess of 90 days past <br /> due on October 1 of any year may be certified to the County Auditor for collection <br /> with real estate taxes in the following year pursuant to Minn. Stat. § 444.075, Subd. 3. <br /> In addition, the City may bring a civil action or exercise other legal remedies to <br /> collect unpaid facilities charges. <br /> -3- <br />
