Recipients of Notice of Claim Letter <br /> June 4, 1993 <br /> Page 2 <br /> • There have been many misleading or erroneous <br /> statements made and- repeated as to the membership <br /> of the Trust and the nature of those companies. <br /> The final Trust Agreement has been released and has <br /> been made assessable to parties who have begun the <br /> settlement process. The names of the Trust members <br /> are contained in the Trust Agreement; as can be <br /> seen from reviewing that list, the Trust members <br /> reflect the size range of Minnesota companies in <br /> general and include large, medium, and small <br /> companies who have been members of the Trust since <br /> its inception. <br /> • There have been a number of attorneys soliciting <br /> clients from the companies who received our Notice <br /> of Claim Letter.' Some of those attorneys have <br /> failed to reveal to their prospective clients that <br /> they (or their firm) already represent a settling <br /> member of the Trust. If you are considering <br /> working with an attorney in this matter, you would <br /> be well advised to question that attorney as to the <br /> clients represented by that attorney and the <br /> conflicts those clients represent to your <br /> interests. <br /> • There have been suggestions circulated that the <br /> Trust has as its goal of this cost recovery action <br /> a windfall, which is to say, the Trust intends to <br /> recover all or in excess of all of its costs at the <br /> site so far. This is simply untrue, nor is it <br /> possible. The members of the Trust who have Out up <br /> approximately $6.5 Million to date, collectively, <br /> represent a very small percentage of the total <br /> volume of wastes at the Oak Grove site. The <br /> largest percentage was generated by entities which <br /> do not belong to the Trust. The Trust will seek to <br /> recover, by settlement or subsequent litigation, a <br /> substantial percentage of all amounts expended to <br /> date at the site plus attorneys' fees and costs <br /> incurred in pursuing those additional parties. The <br /> 'One mailing was sent to many companies who did not even <br /> receive our demand. If you are aware of companies who received <br /> such mailings but not a demand from the Trust, please advise them <br /> they are not being pursued in this matter. <br /> 0027903 <br />
