Page Four <br /> F. Superfund Request. • <br /> The MPCA has applied for funds under .the Comprehensive Env-ironmental . Response <br /> Compensation and Liability Act (CERCLA or ''Superfund") to conduct a- major <br /> regional ground water contamination 'study in the: New Brighton Area near TCAAP, <br /> to investigate the feasibility of temporarily providing noncontaminated water <br /> to New Bri'ghton .residents, and to temporarily provide noncontaminated water to <br /> certain private parties.. We hope to have a favorable decision on this request <br /> in a few weeks. <br /> Superfund money,- of course, is meant for investigation and remedy of problems <br /> where no responsible parties are evident or where responsible parties refuse <br /> to act. Regardless of the Army's limited view of its duties under the federal <br /> Superfund Act, ,it is the responsibility of the Army; and perhaps other persons, <br /> to study and remedy pollution effects caused by their activities at TCAAP. <br /> Expenditure of federal Superfund money and state funds for regional. investigations <br /> and remed-ies will in no way relieve or delay the obligations of the Army -and <br /> other parties responsible for TCAAP facilities. <br /> We would hope the Army and other responsible parties would come forward at this <br /> time to conduct the necessary studies and implement the necessary remedial <br /> action, but, if not, we will assuredly seek reimbursement from the Army and <br /> others for funds we spend. <br /> Each of the requirements described in this letter has been discussed by <br /> members of my staff with TCAAP and USATHAMA officials a- number of times since <br /> the summer of 1981. . The Army was initially given the opportunity of determining, <br /> through . its own studies, whether TCAAP is a source of contaminants. The Army's <br /> Phase I Study has demonstrated that TCAAP is a source, and further that <br /> contaminants have migrated beyond TCAAP's boundaries. It is now appropriate <br /> for the Army and other parties responsible for TCAAP operations to immediately <br /> move ahead with both on-site and off-site measures. <br /> Please . respond to this- letter by April 1, 1983. Your response should state <br /> the intentions of the Army towards fulfillment of each of the requirements <br /> described in this letter. Further, your reply should propose schedules by <br /> which necessary actions will be taken. <br /> At this time my intent is to schedule this matter for MPCA Board consideration <br /> at the April 26, 1983, Board meeting. We request that the Army plan to have <br /> a representative at that meeting to advise the Board of the Army's position <br /> and intention on this matter. , <br /> i <br />
