No single or two family structure or dwelling unit which is a part of a multiple 7 dwelling located within the City may be voluntarily conveyed for consideration by deed or 8 contract for deed after month, date year, unless the person relinquishing ownership or 9 Certificate of Housing Maintenance compliance. 10 11 2. This subsection shall not apply to any apartment house or rental home licensed 12 under subsection xxx.xx of this code and shall have no effect upon the provisions of law or P 13 other ordinances related to the issuance of building permits. 14 15 APPLICATION AND INSPECTION. 16 17 1. Application for the Certificate of Housing Maintenance Compliance shall be 18 executed upon forms provided by the City and accompanied by the initial fee established in 19 Appendix X of this code. 20 21 2. Upon receipt of a properly executed application, the City Manager or his/her 22 designee shall cause an inspection to be made of the premises to ensure the structure is in 23 compliance with applicable provisions of subsection xxxx through xxxx of this code (the 24 housing maintenance code). 25 26 ISSUANCE OF CERTIFICATE. If the structure is in compliance with the requirements 27 of the housing maintenance code, a certificate shall be issued to the person relinquishing 28 ownership or the agent thereof, stating that the structure has been inspected and is in 29 compliance with the housing maintenance code. During the period of one year following its 30 issuance, a certificate may be accepted by the City in satisfaction of the requirements of this 31 subsection without the need for a second inspection. 32 33 OCCUPANCY PROHIBITED. The person relinquishing ownership or their designated 34 agent shall obtain the certificate from the City prior to transfer of ownership. The 35 prospective owner shall not occupy the structure prior to issuance of the certificate, except 36 pursuant to subdivision (the next section). 37 38 OCCUPANCY. A person may be granted permission to occupy a dwelling prior to 39 issuance of the certificate upon the approval of the City Manager. The approval shall be 40 based upon undue hardship or other extraordinary or exceptional circumstances, provided 41 that no such occupancy constitutes an immediate hazard.
