Subd. 11. Sale. The transfer of the title or possession of a dwelling whether or <br /> not absolute title is transferred. <br /> Subd. 12. Structure. Anything constructed, moved, or erected and the use of <br /> which requires location on the ground-or attached to something having a <br /> location on the ground, but excluding fences, sidewalks,-retaining walls, and <br /> items of an ornamental or decorative nature. <br /> Subd. 13. Vacant. A dwelling which is not occupied. <br /> 1306.03 Evaluation Report. <br /> Subd. 1. Requirement. Except as set forth in this Section, no single-family <br /> dwelling, two-family dwelling, mobile home, or a unit in a multiple-family <br /> dwelling located in the City may be voluntarily offered for sale or conveyed by <br /> deed or contract for deed until the owner or owner's agent has first applied for <br /> and secured an evaluation report prepared by an evaluator licensed under this <br /> Section. A separate evaluation report shall be prepared for each dwelling or <br /> structure. <br /> No person shall offer for sale by exhibiting or showing a dwelling or structure <br /> within the City without first having obtained an evaluator's report and an <br /> inspection as described in this Section. The evaluation report shall be <br /> conspicuously displayed for inspection at the premises at all times that such <br /> dwelling or structure is being offered for sale. <br /> Subd. 2. Occupancy by Buyer. A valid evaluation report must be completed <br /> for the dwelling in question and shall be provided to the buyer before or at the <br /> time of sale of the dwelling or structure. The buyer shall not occupy the <br /> dwelling or structure prior to issuance of the evaluation report. <br /> Subd. 3. Valid Evaluation Report. If the dwelling or structure is in compliance <br /> with the.requirements of this Section, the evaluation report shall state that the <br /> dwelling or structure has been inspected and is in conformance with this Section <br /> of the City Code. An evaluation report is valid for 1 year from the date of its <br /> issuance. The report is valid only for the owner listed on the report. <br /> 1306.04 Exceptions. The provisions of this Section do not apply to: <br /> Subd. 1. New Construction.Any newly constructed dwelling or structure when <br /> title is transferred to the first owner. <br /> Subd. 2. Sale to a Public Entity. The sale or transfer of title of any dwelling or <br /> structure to a public entity. <br />
