130 <br /> (2) A statement indicating that failure to comply with the conditions of <br /> approval shall result in the removal of the tower/antenna structure. <br /> (3) A statement indicating that the expenses incurred by the City to <br /> enforce the provisions of the Wireless Telecommunication <br /> Tower/Antenna Agreement shall be reimbursed by the applicant. <br /> (4) A statement which requires the applicant to utilize the procedures <br /> established by the FCC to resolve any complaints received relating to <br /> interference allegedly caused by the Wireless <br /> Telecommunication/Tower Antenna. <br /> (5) A statement indicating that a wireless telecommunication tower <br /> which has not been used for twelve (12)successive months shall be <br /> deemed abandoned and may, at the sole discretion of the City, be <br /> required to be removed in the same manner and pursuant to the same <br /> procedures as for dangerous or unsafe structures established by <br /> Minnesota State Statutes, Section 463.16. <br /> (6) A statement indicating that the removal of any unused or abandoned <br /> tower or portions of towers shall be the responsibility of the property <br /> owner. <br /> (7) A statement requiring the permittee to notify the City that the <br /> tower/antenna continues to be in operation. The notice of continuing <br /> operation shall be sent to the City Planner annually by certified mail <br /> during the last two weeks of the month of December. <br /> (5) Collocation Requirements: Except as herein and after provided, wireless <br /> telecommunication towers/antennas within the City shall comply with <br /> the following collocation requirements: <br /> (a) all proposed wireless telecommunication towers/antennas must be <br /> located on an existing tower or building that exceeds 75 feet in <br /> height and is located within a quarter mile of the site being <br /> considered by the applicant. <br /> (b) all proposed wireless telecommunication facilities shall be designed, <br /> structurally,electrically, and in all respects, to accommodate both <br /> the applicant's antennas and comparable antennas for at least one <br /> additional user if the tower is over 75 feet in height. <br /> (c) all proposed wireless telecommunication facilities must be designed <br /> to allow for future rearrangement of antennas upon the tower and to <br /> accept antennas mounted at various heights. <br /> (6) Exceptions to Collocation Requirements: The City Council may waive <br /> any or all of the collocation requirements if it is determined that: <br /> (a) the planned equipment would exceed the structural capacity of the <br /> existing or approved tower or building, as documented by a qualified <br /> and licensed professional engineer, and the existing or approved <br /> 200- 141 <br />
