129 <br /> a notice of intent shall be sent to all property owners within 350 feet of the <br /> perimeter of the property. Written comments will be requested within 10 <br /> days, reviewed, and a final determination made by the City Planner within 30 <br /> days of date of the City Planner's receipt of a completed application. The <br /> City Planner's final determination shall be forwarded in writing to the <br /> applicant and property owners within 350 feet of the perimeter of the <br /> property. The applicant or property owner within the 350 foot notification <br /> radius may appeal the City Planner's decision by filing a notice of appeal with <br /> the City.Manager within 10 days of the date on the notice of the City <br /> Planner's decision. The notice of appeal shall indicate why the appellant has <br /> concluded that the City Planner's decision was not based on a proper <br /> evaluation of the tower compliance standards. The City Manager shall place <br /> the appeal on the next available City Council agenda. If the City Planner's <br /> decisions is to approve, and there are no appeals, the City Planner shall report <br /> the decision to the Planning Commission and City Council and the applicant <br /> shall enter into an agreement as defined in Section 207.110(E)(4)(b). <br /> (4) Planning Commission/City Council Review. Applications for a wireless <br /> telecommunication tower/antenna permits located in residential zones, except <br /> those eligible for administrative review, shall be reviewed by the Planning <br /> Commission and City Council. <br /> (a) Planning Commission Review. Upon receipt of a completed application, <br /> the City Planner shall schedule a hearing before the Planning <br /> Commission which shall be preceded by ten days mailed notice to the <br /> record owners of property located within 350 feet of the parcel on which <br /> the tower/antenna will be located. The Planning Commission shall make <br /> findings based upon the tower compliance standards and shall submit its <br /> recommendations to the City Council. <br /> (b) City Council Review. Upon receipt of Planning Commission <br /> recommendations, the City Council shall review the application. The <br /> City Council may approve the application subject to conditions, table its <br /> review until a date certain, or deny the application for a wireless <br /> telecommunication tower/antenna permit. If the application is denied, the <br /> City Council shall state its reasons. If the application is denied,the City <br /> Council shall state its reasons. If the application is approved by the City <br /> Council, a Wireless Telecommunication Tower/Antenna Permit and a <br /> Building Permit shall be issued upon the execution of a Wireless <br /> Telecommunication Tower/Antenna Agreement. The agreement or a . <br /> summary of the agreement approved by the City Planner, in a recordable <br /> form, shall be signed by the applicant and property owner and the terms <br /> of the agreement shall include the following: <br /> (1) A list of the conditions of approval to the Wireless <br /> Telecommunication Tower/Antenna Permit. <br /> 200- 140 <br />
