STAFF REPORT To: Planning Commission Report No.: VII.2 From: Kim Moore-Sykes,Assistant City Manager Date: December 21,2004 Subject: Subdivision of Property at: Lot 4, Block 1,Apache Plaza, and Lot 4, Block 1, Silver Lake Village, proposed address of 2504—39's Avenue NE. Requested Action: Staff is asking the Planning Commission to review the Silver Lake Homes I,Lot Split/Subdivision request and based on the findings of facts from the public hearing,recommend approval to the City Council. Background: Hunt Associates,owner of the 5.4 acre property located east of Stinson Boulevard and just south of 39`h Avenue,in the SW'/4 of Section 31,Township 30N,Range 23W. This parcel included a portion of Apache Lane. According to the terms of Silver Lake Village Developer's Agreement, Section 3.11 Street Vacations within the Development Property, the applicable Developer shall apply for any such vacation in accordance with the ordinances of the City. This vacation was applied for by the property owner and granted by the City Council at the conclusion of the public hearing held on November 9, 2004. The owner is now requesting that those parcels described as Lot 4,Block 1,Apache Plaza,Ramsey County,Minnesota, according to the plat thereof;and Lot 4,Block 1, Silver Lake Village,Ramsey County,Minnesota, according to the plat thereof be subdivided and replatted to include the vacated portion of Apache Lane. The proposed legal description for these lots is,Lots 1 and 2,Block 1, Silver Lake Homes, Ramsey County,Minnesota,according to the plat thereof. The proposed street address is 2504—39h Avenue NE.
