The use or disclosure br a,,)\r party of information <br /> concerning an applicant or participant in the program in violation of•the Minnesota <br /> Government Data Practices Act or any other applicable law or rule of confidentiality is <br /> prohibited, except on the written, informed consent of the applicant or participant. <br /> 3.04 No Charge for Services. All services furnished under this agreement shall be without <br /> charge to and applicant, participating family, or o«•ner. <br /> 3.05 Disputes. All problems or disputes between the•parties hereto shall be subject to review <br /> and resolution by the Metropolitan Housing and Redevelopment Authority Advisory <br /> Committee or other committees subsequently designated by the Council. <br /> 3.06 Independent Contractor. The City acknowledges its status as an independent contractor <br /> under this aereement and agrees that it will conduct itself consistent with such status and <br /> that it will not hold itself out or claim that its officers and employees are employees of the <br /> Council. By reason hereof, it will make no claim, demand, or application to or for any right <br /> or privilege applicable to any officer or emplovee of the Council including, but not limited <br /> to, workers' compensation coverage, unerployment insurance benefits, social security <br /> coverage, or retirement membership or credit, and shall defend the Council and hold it <br /> harmiess from any such claims brought by employees or agents of the City. <br /> 3.07 Master Contract. The City understands that the program is subject to the terms and <br /> conditions of the Master Contract and to HUD's current and future rules and re(2uiations, <br /> • and the City agrees to abide by the same and to cooperate with the Council in its <br /> compliance therewith. <br /> 3.08 Conflict of Interest. All members, officers, and emoiovees of the parties hereto shall <br /> comply with applicable provisions of state conflict of interest la,-;• contained in Minnesota <br /> Statutes Section 462.32 and with federal guidelines contained in Section 2.16, Form HUD <br /> 52520C (Annual Contributions Contract Part II). <br /> 3.09 Prior Contract Superseded. This contract supersedes prior Section 8 Housing Assistance <br /> Payments Program Contracts for Inspection Services, it any, entered into between the <br /> parties. <br /> 3.10 Amendment. i ne terms of this contract may be changed or modified b\, mutual agreement <br /> of the r)arties hereto.
