• for positions such as the city engineer, city assessor, police
chief, etc. Assuming that these positions are "officials" or
"officers" (rather than mere "employees") , they too might not be
eligible for workers compensation benefits in the absence of an
ordinance or resolution extending coverage to them.
2 . How does the $70 per week imputed salary enter into the
calculation of premiums for these officials?
The $70 per week figure is a minimum salary to be used in
calculating premiums for these officials. If the actual
salaries are greater than $70 per week, premiums are based on
the actual salaries. The premium rate applied will .be $2.91 per
$100 of payroll.
This same approach and rate will also be used to calculate
premiums for coverage for any other boards, commissions, or
committees which are specified in the city's ordinance or
resolution extending coverage. Unless the city specifically
indicates that members of a particular board are covered, LMCIT
will assume that they are not.
3 . In the event of an injury, how would workers compensation
• benefits. be calculated for elected officials or members of other
covered boards or commissions?
As is the case with any other employee, benefits would be
calculated based on the individual's actual earnings from all
employment. In other words, benefits would be based on the
total earnings from the official's regular employment plus the
salary (if any) he receives from the city. The $70 per week
imputed minimum salary is used solely to calculate premiums, and
does not figure into the benefit calculation in any way.
The workers compensation statutes specify certain minimum and
maximum benefits. The minimum and maximum are based on the
statewide average weekly wage, which is calculated each year by
the state Department of Labor and Industry. Currently, benefits
are as follows:
Average gross weekly wage Work. comp. payable per week
$586. 50 or above $391
$293 . 25 to $586.50 2/3 of average gross weekly wage
$195. 50 to $293 . 25 $195. 50 (50% of statewide ave. )
• 0 to $195.50 Actual gross wage, but never
less than $78.20
