She felt there was no hardship, but rather <br /> 5 an inconvenience. <br /> 6 <br /> 7 Councilmember Marks advised that the Council , by State law, are not <br /> 8 supposed to approve any variance unless it is truly a hardship. He <br /> 9 referred to examples of hardships. <br /> 10 <br /> 11 Noting that the members of the Planning Commission recommended approval <br /> 12 of the variance request by a four to three vote, Commissioner Faust <br /> 13 advised the Council how members of the Commission reached their vote. <br /> 1, <br /> 15 Councilmember Makowske observed that in the past the Council had granted <br /> 16 variance to property owners who were building garages but she stated she <br /> 17 did not really see anything unique nor extraordinary with this request . <br /> 18 <br /> 19 The City Manager stated that staff checked the records regarding any <br /> 20 precedence which may have been set in prior situations. He gave two <br /> 21 examples of variances granted for garages in Mr. Drews' neighborhood. <br /> 22 <br /> �3 The City Attorney said the question is one of an existing hardship. <br /> 24 He felt there is no hardship that could meet the test of the State <br /> •25 nor City ordinances. Councilmember Enrooth stated he hopes the Council <br /> 26 continues to apply stricter enforcement of the ordinance. <br /> 27 <br /> 23 Motion by Makowske, second by Marks to deny the request for a setback <br /> 29 variance at 2609 St . Anthony Boulevard there being no conditions which <br /> 30 would allow the Council to grant the variance. <br /> 31 <br /> 32 Roll call : Makowske, Marks , Ranallo - aye <br /> 33 Enrooth - nay <br /> 34 Wagner - abstain <br /> 35 Motion carried. <br /> 36 2. S. Clarke, setback variance for 3305 Edward Street <br /> 37 Sharon-Lee Clarke is requesting an 11 .43 foot variance to the back yard <br /> 38 setback requirement of the City Zoning Ordinance to be allowed to con- <br /> 39 struct a 12 foot by 9. 33 foot three season porch. The Zoning Ordinance <br /> 40 requires that there shall be a rear yard measuring in depth a distance <br /> 41 equal to 20% of the depth of the entire lot, but in no case less than <br /> 42 twenty-five feet . Twenty percent of the Clarke lot is less than 25 <br /> 43 feet , therefore the required backyard setback would be 25 feet. If <br /> 44 the variance were granted , the backyard setback from the porch would <br /> 45 be 13.57 feet . <br /> 46 <br /> 47 Ms. Clarke stated she had grown up in this area and has family close <br /> 48 to the site she has chosen on which to build her home .
