Ste. Marie Company has included language in the pending purchase <br /> agreement that would bind the purchaser to rectify the situation to the District's satisfaction <br /> in the event a RCWD permit is required in connection with the purchaser's plans for the site. <br /> If this approach does not result in corrective action or obligation satisfactory to the District <br /> before June 1,2001 then the Ste.Marie Company will construct a bituminous overlay as <br /> described above. Of course,if the purchaser is required to obtain a permit from RCWD in <br /> connection with its plans for the site,Ste.Marie Company will not be required to do any <br /> corrective work on 39`'Street. <br /> Ste.Marie Company does not hereby admit that it has any legal liability,to do this remedial work. but in <br /> the interests of resolving this problem,has proposed to do the foregoing. <br /> I believe this reflects our discussions and understanding of the most practical approach to resolving these <br /> issues.
