City of Saint Anthony Housing Maintenance Ordinance Draft Number 3 -- March 23, 1992 Page Number 17 1 All persons authorized to inspect shall have the authority to enter, at reasonable 2 times, any multiple dwelling licensed pursuant to this ordinance. 3 4 Persons inspecting a multiple dwelling shall notify the licensee of all violations, if any, 5 by written notice. The notice shall direct compliance in not less than 15 days, unless 6 extended by the City Manager for good cause. 7 8 REVOCATION OR SUSPENSION. 9 10 Every license issued under this ordinance is subject to the right, which is hereby expressly 11 reserved, to suspend or revoke the same should the licensee or the licensee's agents, 12 employees, representatives or lessees directly or indirectly operate or maintain a multiple 13 dwelling contrary to the provisions of state or federal law, this.or any other ordinance of the 14 City, or any permit issued by the City. 15 16 A license may be suspended or revoked by the Council after written notice to the licensee 17 specifying the violations. The notice shall also specify the date for a hearing before the 18 Council, which "shall not be less than 10 days after the date of the notice. 19 20 At the hearing, the licensee may present any evidence relevant to the violations specified in 21 the notice. 22 23 After a hearing, the Council may suspend or revoke the license if deemed necessary to 24 protect the public health, safety or welfare. 25 26 SUMMARY ACTION.. 27 28 When the conduct of a licensee or the licensee's agent, representative, employee of lessee, 29 or the condition of the licensed multiple dwelling, constitutes a nuisance, fire or health 30 hazard, unsafe or dangerous condition, or other emergency, the City Manager may 31 summarily condemn or close off the multiple dwelling or a portion thereof. 32 33 Any person aggrieved by a decision of the City Manager shall be entitled to appeal to the 34 Council, immediately, by filing a notice of appeal with the Manager. The Manager shall 35 schedule a date for hearing before the Council and notify the aggrieved person of the date. 36 37 The hearing shall be conducted in the same manner as if the aggrieved person had not 38 received summary action. 39 40 The decision of the City Manager shall not be voided by the filing of such appeal. Only 41 after the City Council has held its hearing will the decision of the City Manager be affected. 42
