-3- <br /> When Councilman Marks questioned whether the hours of operation should be specifically <br /> • set for the store, Mr. Childs told him the City Ordinance only limits the hours of <br /> operation for businesses identified as "recreational ", a classification he perceives <br /> would probably not be applicable to a video store of this type. <br /> Mr. Applebaum was present but offered no further input to the discussion.. <br /> Motion by Councilman Makowske and seconded by Mayor Sundland to grant a conditional <br /> use permit to Howard Applebaum, 1583 Saunders, St.. Paul , Minnesota, to operate a <br /> video cassette equipment sales and rental store in Apache Plaza, as proposed, subject <br /> to the following conditions set for this type of operation by the City Ordinance: <br /> 1 . There would be no viewing of tapes in the store, except for bona fide demonstra- <br /> tions of tapes and no viewing would be visible from outside the store; <br /> 2. The proprietors must comply with all state laws relating to obscenity and to any <br /> ordinance of the City of St. Anthony thereafter relating to obscenity; <br /> 3. Conviction of the owner, or any of the employees of the owner, for violation of <br /> obscenity laws in the operation of the store would be grounds for revocation <br /> of this permit by the City Council ; and <br /> 4. Any identification of the business would be required to conform to the City Sign <br /> Ordinance. <br /> In granting this permit, the Council finds: <br /> • 1 . The proposed conditional use will not be detrimental to the health, safety, or <br /> general welfare of persons residing or working in the vicinity or injurious to <br /> property values or improvements -in the vicinity; <br /> 2. The proposed conditional use will not be detrimental to the health, safety, or <br /> general welfare of persons residing or working in the vicinity or injurious to <br /> property values or improvements in the vicinity; and <br /> 3. The proposed conditional use is necessary or desirable at the above location <br /> to provide a service or a facility which is in the interest of public convenience <br /> and will contribute to the general welfare of the neighborhood or community. <br /> Motion carried unanimously. <br /> The Council next received Commissioner Bowerman 's report on the signage requested for <br /> the Hair Station which is located in the same building at 3909 Silver Lake Road <br /> formerly tenanted by Craig & Company. The Planning Commission representative <br /> reiterated much of the discussion the Commission members had with the applicant, <br /> Dan Jaeger, regarding the sign he proposes to erect on the same base which had <br /> supported the sign for Craig & Company, which had been blown down in the tornado. <br /> Mr. Jaeger assured the Councilmembers that he intended only to berm around the <br /> existing base to provide stability for the sign, and not to build up the height of <br /> the sign itself. The shop proprietor indicated he would remove the rubble of the <br /> former sign from the site as soon as possible and would only incorporate the logo <br /> used for his other shops if he can work it into a sign size which would conform to <br /> • the City Sign Ordinance. <br /> Motion by Councilman Marks and seconded by Councilman Enrooth to grant the variance <br /> to the City Sign Ordinance which would accept the design proposed for the free <br />
