Northeast) within the limits of the City as a county state aid highway project have <br /> been presented to the City; and <br /> WHEREAS, the Minnesota Department of Transportation has determined storm <br /> sewer cost participation based on contributing areas and existing outfall lines credit;and <br /> WHEREAS, the City and County will participate in the cost, operation and <br /> maintenance of said project as herein set forth. <br /> NOW, THEREFORE, IT IS.HEREBY MUTUALLY AGREED AS FOLLOWS; <br /> 1. The County shall prepare the necessary plans, specifications, proposals, take <br /> bids and recommend the Commissioner of Transportation award a contract for the <br /> construction of this project, S.P. 62-619-04; the County shall perform the construction <br /> inspection. <br /> 2. The County shall by separate agreement with Hennepin County, administer <br /> that portion of the work In the City in Hennepin County with Hennepin County. <br /> - 3. The City shall administer that portion of the work In the City In Hennepin • <br /> County with Hennepin County. <br /> 4. The County shall acquire additional permanent right of way and temporary <br /> easements required for the construction of this project In accordance with the plans <br /> and specifications. The County shall pay for all additional rights of way in the County. <br /> 5. All County Road D rights of way and temporary easements in the County <br /> will be in the name of the County, and parking and other regulations will be controlled <br /> by the County. <br /> 6. Water main Improvements by the City proposed In cooperation with the project <br /> shall be at the City's sole expense. <br /> 7. Community Development Block Grant (CDBG) funds paid to the County by <br /> the City in accordance with terms of a separate agreement shall be used to credit to <br /> the City by the County costs attributable to the City in accordance with the terms of <br /> this agreement. Estimated costs, based on the engineer's estimate, are attached as <br /> Exhibit A. <br /> Any utilities or facilities modified or added to those provisions presently made <br /> In the plans and specifications may be Incorporated in the construction contract by <br /> supplemental agreement and shall be paid for by the City as specified In the supplemental <br /> agreement without consideration of the aforesaid CDBG funds. <br /> 8.
