a
y
.t
t
.E
MEMORANDUM
DATE: October 23, 1984
TO: Mayor and Council
FROM: _ David M. Childs , City Manager
SUBJECT: Repealing Gambling and Raffle Ordinance
--------------------------------------------------------------------
In response to a request from the St. Anthony American Legion, I
have instructed Bill Soth to prepare the attached Ordinance. The
Ordinance previously passed by the Council did two things :
1 . Repealed the Bingo Ordinance , effective March, 1985 .
2 . Repealed the City ' s Ordinance ,regarding charitable gambling,
raffles , etc. , thus allowing the state law to prevail,
effective March, 1985 .
Where the City Ordinance fell short, however, is that state law now
controls charitable gambling , but until March, 1985 , the state
permits cities to license charitable gambling and without such
a permissive local ordinance , charitable gambling is not allowed.
All the recently passed Ordinance did was remove the prohibitions ,
but it did not provide for licensing during the five month interim.
The attached Ordinance would resolve the five month interim problem
by establishing licensing procedures for charitable gambling , both
for the St. Charles Mardi Gras_ activities and the proposed activities
of the American Legion.
' I recommend approval of the Ordinance, waiving of the readings , if
the Council is agreeable and establishment of the remaining fee
at not less than $100 .00 to partially cover the legal costs of the
Ordinance . For . one-time events , the Council could still waive the
i fees .
DMC/cjk
i
i
I
