Childs , City Manager <br /> SUBJECT: Repealing Gambling and Raffle Ordinance <br /> -------------------------------------------------------------------- <br /> In response to a request from the St. Anthony American Legion, I <br /> have instructed Bill Soth to prepare the attached Ordinance. The <br /> Ordinance previously passed by the Council did two things : <br /> 1 . Repealed the Bingo Ordinance , effective March, 1985 . <br /> 2 . Repealed the City ' s Ordinance ,regarding charitable gambling, <br /> raffles , etc. , thus allowing the state law to prevail, <br /> effective March, 1985 . <br /> Where the City Ordinance fell short, however, is that state law now <br /> controls charitable gambling , but until March, 1985 , the state <br /> permits cities to license charitable gambling and without such <br /> a permissive local ordinance , charitable gambling is not allowed. <br /> All the recently passed Ordinance did was remove the prohibitions , <br /> but it did not provide for licensing during the five month interim. <br /> The attached Ordinance would resolve the five month interim problem <br /> by establishing licensing procedures for charitable gambling , both <br /> for the St. Charles Mardi Gras_ activities and the proposed activities <br /> of the American Legion. <br />' I recommend approval of the Ordinance, waiving of the readings , if <br /> the Council is agreeable and establishment of the remaining fee <br /> at not less than $100 .00 to partially cover the legal costs of the <br /> Ordinance .
