CHAPTER 10. ALCOHOLIC BEVERAGES <br /> Section 1000 - REGULATIONS <br /> 1000.01 Definitions. For purposes of this Code, the following terms have the <br /> following meanings: <br /> Subd. 1 Beer. Nonintoxicating malt liquor as defined in Minn. Stat. <br /> §340A.101, Subd. 19. <br /> Subd. 2 Restaurant. An establishment, under the control of a single <br /> proprietor, having seating for at least 50 people with appropriate facilities for <br /> serving meals, where meals are regularly served at tables to the general <br /> public, and which employs an adequate staff to provide the usual and suitable <br /> service of such meals. <br /> Subd. 3 Other Terms. Other terms used in this Section will have the <br /> meanings given them in Minn. Stat. §340A.101. <br /> • 1000.02 License Required. <br /> Subd. 1 Intoxicating Liquor. No person may directly or indirectly, on any <br /> pretense or by any device, sell, barter, keep for sale, or otherwise dispose of <br /> intoxicating liquor as part of a commercial transaction except an employee of <br /> the City doing so on behalf of the City or except a person doing so pursuant to <br /> an on-sale wine license issued under Section 1005. <br /> Subd. 2 "On-Sale" and-"Off-Sale" Licenses. No person may sell, vend, deal <br /> in or dispose of, or keep for sale, any beer within the City without first having <br /> received an appropriate license. Licenses are of two kinds: "on-sale" and <br /> "off-sale". <br /> Subd. 3 Retail On-Sale Licenses. Retail on-sale licenses permit the licensee <br /> to sell beer for consumption on the premises only. "On-sale" licenses may be <br /> granted only to a restaurant. <br /> Subd. 4 Retail Off-Sale Licenses. Retail off-sale licenses permit the licensee <br /> to sell beer in original packages for consumption off the premises only. <br /> 1000.03 Application for license. An application for a license to sell beer must be <br /> made on a form supplied by the Clerk. The application must include the name of <br /> the applicant, applicant's age, representations as to applicant's character and any <br /> 10-1 <br />
