be grounds for revocation. No portion of the license fee will be returned upon <br /> revocation. <br /> 1000.11 Compliance with State Law. All licenses issued pursuant to this Section and <br /> all operations of "on-sale" and 'off-sale" businesses within the City, are subject to <br /> Minn. Stat. §340A.411 in addition to the provisions of this Section. <br /> 1000.12 Sale of "Set-Ups" <br /> Subd. 1 Permit Required. It is unlawful for any private club or public place, <br /> directly or indirectly, or upon any pretense or by any device, to allow the <br /> consumption or display of intoxicating liquor, or the serving of any liquid for <br /> the purpose of mixing with intoxicating liquor, commonly called "set-ups," <br /> without first having obtained approval of the Council and a permit from the <br /> Commissioner of Public Safety. r <br /> Subd. 2 Approval in Writing. No permit will be approved by the Council <br /> unless the applicant agrees in writing that as a condition.of the approval, <br /> "set-ups" will be served only in a room separate and apart from any room <br /> licensed for the sale of intoxicating liquor. A violation of this provision will <br /> be cause for revocation of the permit. <br /> Subd. 3 Fees. Each person obtaining approval of the Council and a.permit <br /> from the Commissioner of Public Safety must pay to the Clerk the fee set <br /> forth in Section 600. Approval of the permit may be revoked at any time for <br /> cause by the Council in the manner provided in Section 1000.06, Subd. 4. The <br /> revocation will not entitle the holder of the permit to a rebate of any portion <br /> of the fee. <br /> 1000.13 Existing Licenses. Any premises for which an "on-sale" license was in effect <br /> on September 14, 1982, will qualify for the issuance or renewal of an 'on-sale" <br /> license, notwithstanding the fact that the premises is not a restaurant as defined in <br /> Section 1000.01, Subd. 2, if (a) the other requirements for issuance or renewal of the <br /> license are met, (b) the premises has not been without an "on-sale" license for a <br /> period of more than 6 months, and (c) sale of beer for consumption on the premises <br /> has not ceased for a period of more.than 6 months. <br /> 1000.14 Consumption. No person may consume intoxicating liquor in a public <br /> park, on a public street or in any public place other than a City on-sale liquor store. <br /> Section 1005 - ON-SALE WINE LICENSE <br /> 1005.01 License Required. A "restaurant", as defined in Section 1001, Subd. 2, may <br /> sell wine, not exceeding 14% alcohol by volume, at retail only for consumption on • <br /> 10-4 <br />
