Subd. 2 Medical Exceptions. The provisions of Minn. Stat. §§152.0974, 152.11 <br /> and 152.12, are made a part of this Section, and apply as lawful exceptions. <br /> Subd. 3 Marijuana Defined. Marijuana means marijuana as defined in <br /> Minn. Stat. §152.01, Subd. 9. <br /> Subd. 4 Small Amount Defined. "Small amount" means 1.5 ounces or less of <br /> the non-resinous form of marijuana. <br /> Subd. 5 Possession in a Motor Vehicle. It is unlawful for a person who is the <br /> owner of a motor vehicle, or the driver of the motor vehicle if the owner is <br /> not present, to possess-or knowingly keep or allow to be kept in a motor <br /> vehicle within the area of the vehicle normally occupied by the driver or <br /> passengers more than .05 ounce of marijuana. The prohibited area does not <br /> include the trunk of the vehicle but does include the utility or glove <br /> compartment. <br /> Subd. 6 Penalties. <br /> (a) Possession of Small Amount - First Conviction. Any person who <br /> violates the provisions of 1140.0.1, Subd. 1 is guilty of a petty <br /> • misdemeanor. <br /> (b) Possession of Small Amount - Second Conviction. Any person <br /> who after being convicted for possession of a small amount of <br /> marijuana under 1140.01, Subd. 1 is subsequently convicted for the <br /> same offense within two years after the first conviction is guilty of a <br /> misdemeanor. <br /> (c) Possession in Motor Vehicle. Any person who violates the <br /> provisions of 1140.01, Subd. 5 is guilty of a misdemeanor. <br /> Subd. 7 Discharge and Dismissal. The provisions of Minn. Stat. §152.18 are <br /> made a part of this Section and apply to violations of this Section. <br /> Subd. 8 Forfeiture. All marijuana which has been possessed in violation of <br /> this Section is subject to forfeiture and may be seized without process when <br /> the seizure is made incident to an arrest or pursuant to a search warrant. <br /> SECTION 1145 - NOISE IN RESIDENTIAL AREAS <br /> 1145.01 Noise in Residential Areas. No person may congregate with others because <br /> of, or participate in, any party or gathering of people from which noise emanates of a <br /> • sufficient volume so as to unreasonably disturb the peace, quiet or repose of persons <br /> 11-9 <br />
