1200.02 Public Nuisances. A person who intentionally does any of the following by • <br /> action or failure to perform a legal duty is guilty of maintaining a public nuisance: <br /> (a) Maintains or permits a condition which unreasonably annoys, injures or <br /> endangers the safety, health, morals, comfort or repose of a significant <br /> number of the public. <br /> (b) Offends public decency. <br /> (c) Renders the public insecure in life, safety or use of property. <br /> 1200.03 Public Nuisances Declared. The following are declared to be public <br /> nuisances: <br /> Subd. 1 Garbage. Garbage not contained within an authorized private <br /> receptacle. <br /> Subd. 2 Diseased Animals. All diseased animals running at large. <br /> Subd. 3 Ponds or Pools. All ponds or pools of stagnant water. <br /> Subd. 4 Carcasses. Carcasses of animals not buried or destroyed within 24 <br /> hours after death. • <br /> Subd. 5 Refuse. Accumulations of refuse contrary to the provisions of <br /> Subsection 1200.04. <br /> Subd. 6 Outhouses. Toilets not connected to the public sanitary sewer system. <br /> Subd. 7 Garbage Cans. Garbage cans or receptacles which are not rodent free <br /> or which may otherwise constitute a health hazard or emit foul or <br /> disagreeable odors. <br /> Subd. 8 Water Pollution. Pollution of any public well or body of water by <br /> sewage, industrial waste, refuse or other substances. <br /> Subd. 9 Weeds and Vegetation. All noxious weeds and other rank growths of <br /> vegetation upon public or private property. <br /> Subd. 10 Smoke, Fumes. Gas, and Soot. Dense smoke, noxious fumes, gas or <br /> soot. <br /> Subd. 11 Communicable Disease. Public exposure of a communicable disease. <br /> • <br /> 12-2 <br />
