1 REGULAR COUNCIL MEETING <br /> 0 APRIL 28 , 1992 <br /> _ PAGE 9 <br /> 4 <br /> 5 <br /> 6 Motion by Fleming, second by Ranallo to deny the request <br /> 7 of the owner of Sheik ' s _Garden Restaurant for a <br /> 8 conditional use permit . <br /> 9 <br /> 10 The Mayor stated his lack of support for the request is <br /> 11 based on the history of problems which have been <br /> 12 experienced in Apache Plaza with similar amusement <br /> 13 devices . He feels that this type of activity generates <br /> 14 extra police calls , is not desirable .for public <br /> 15 convenience and has a negative impact on the welfare of <br /> 16 the City . <br /> 17 <br /> 18 Marks inquired if there is a mix of adult and children <br /> 19 amusement devices . Knutson responded that is the plan . <br /> 20 The Mayor stated he had no problem with kiddy amusement <br /> 21 devices only, but could not support the fifteen adult <br /> 22 amusement devices be.ing requested. Fleming had concern , <br /> 23 with the " family environment " section of the application . <br /> 24 <br /> 25 Knutson reviewed the floor plan again . He noted the <br /> 26 proposed placement of the amusement devices . It was his <br /> opinion that the economics to make the operation viable <br /> _ were very difficult and that the devices would aid in the <br /> 29 economics . <br /> 30 <br /> 31 Wagner stated he had met with Mr . Alwan and requested he <br /> 32 decrease the number of amusement devices being requested . <br /> 33 <br /> 34 Marks recalled that the Malt Shop had pool tables which <br /> 35 tend to attract the undesirable element about which the <br /> 36 Council appears to be concerned. Knutson inquired if the <br /> 37 Council would consider a modification of the request . <br /> 38 <br /> 39 Mayor Ranallo responded that the purpose of the Council <br /> 40 is not to negotiate . He also noted that presently there <br /> 41 are four machines on the premises and only authorization <br /> 42 for three has been given. It was noted that one is not <br /> 43 operable. <br /> 44 <br /> 45 Mary Ann Kuharski , 2709 Pahl Avenue, stated her <br /> 46 opposition to granting of the conditional use permit . She <br /> 47 is not supportive of having twenty-three amusement <br /> 48 devices on the premises . She felt there is a safety <br /> 49 factor which should be considered and questioned who this <br /> 50 establishment is interested in attracting. <br /> 51 <br /> Mr . Alwan felt the restaurant and the amusement devices <br /> would be beneficial for the mall . <br /> 4 <br />
