Minnesota Statutes, Section <br /> 173.17(4), a copy of which is enclosed,states that no lawfully erected advertising device can <br /> be removed until all rights have been acquired by purchase or eminent domain. Chapter <br /> 173, in which this section is located, deals with "scenic areas” as designated and established <br /> by the State Commissioner of Transportation. It also deals primarily with interstate and <br /> primary highways and the scenic areas adjacent to those highways. Reading Section <br /> 173.17(4) in context, it would not appear to be applicable to most signs within the City of <br /> St. Anthony. If you read it literally, however, it states that signs cannot be required to be <br /> removed without compensation. <br /> If the City decides to pursue some plan of calling for the removal of <br /> nonconforming signs after a period of years, we probably should look into this further and <br /> try to determine whether the validity of such provision will be upheld.. <br /> Very truly yours, <br /> William R.
