(c) At the hearing, the licensee may present any evidence relevant to the • <br /> violations specified in the notice. <br /> (d) After a hearing, the Council may suspend or revoke the license if deemed <br /> necessary to protect the public health, safety or welfare. <br /> Section 310:60 Summary Action. <br /> (a) When the conduct of a licensee or the licensee's agent, representative, <br /> employee of lessee, or the condition of the licensed apartment building, <br /> constitutes a nuisance, fire or health hazard, unsafe or dangerous condition, <br /> or other emergency, the City Manager may summarily condemn or close off <br /> the apartment building or a portion thereof. <br /> (b) Any person aggrieved by a decision of the City Manager shall be entitled to <br /> appeal to the Council, immediately, by filing a notice of appeal with the <br /> Manager. The Manager shall schedule a date for hearing before the Council <br /> _--and-notify the aggrieved-person-of-the-date:—-- -- <br /> W The hearing shall be conducted in the same manner as if the aggrieved <br /> person had not received summary action. <br /> (d) The decision of the City Manager shall not be voided by the filing,of such S <br /> appeal. Only after the City Council has held its hearing will the decision of <br /> the City Manager be affected. <br /> Section 310:65 ARRlicable Laws. Licenses shall be subject to state and federal laws <br /> and all ordinances of the City relating to apartment buildings; and this Section <br /> 310:00 shall not be deemed to supersede or limit any other applicable law or <br /> ordinance. <br /> -4- <br />
