"Restaurant. "Restaurant" is an establishment other than a <br /> hotel, under the control of a single proprietor or manager, where <br /> meals are regularly prepared on the premises and served at tables <br /> to the general public, and having a minimum seating capacity for <br /> guests as prescribed by the appropriate license issuing authority." <br /> Sunday Sales of On-Sale L,iguo <br /> Minnesota Statutes, Section 340A.504, subdivision 3, provides that liquor sales <br /> for consumption on premises are not permitted on a Sunday unless the establishment has a <br /> Sunday on-sale liquor license. The City may not issue such Sunday licenses without <br /> authorization by the voters of the City voting on the question of Sunday sales at a general or <br /> special election. The question of the issuance of Sunday on-sale liquor licenses is a separate <br /> question from the question of the issuance of on-sale liquor licenses to hotels and restaurants. <br /> Form of Questions <br /> Should the City Council determine to call for a special election on the question of <br /> the issuance by the City of on-sale liquor licenses, I recommend that the form of question to be <br /> submitted to the voters read as follows: <br /> "Shall the City of St. Anthony be authorized to issue on-sale liquor <br /> licenses to hotels and restaurants as provided in Minnesota <br /> Statutes, Section 340A.661?" <br /> Should the City Council determine to call for a special election on the question of <br /> permitting Sunday on-sale liquor.
