"Restaurant. "Restaurant" is an establishment other than a
hotel, under the control of a single proprietor or manager, where
meals are regularly prepared on the premises and served at tables
to the general public, and having a minimum seating capacity for
guests as prescribed by the appropriate license issuing authority."
Sunday Sales of On-Sale L,iguo
Minnesota Statutes, Section 340A.504, subdivision 3, provides that liquor sales
for consumption on premises are not permitted on a Sunday unless the establishment has a
Sunday on-sale liquor license. The City may not issue such Sunday licenses without
authorization by the voters of the City voting on the question of Sunday sales at a general or
special election. The question of the issuance of Sunday on-sale liquor licenses is a separate
question from the question of the issuance of on-sale liquor licenses to hotels and restaurants.
Form of Questions
Should the City Council determine to call for a special election on the question of
the issuance by the City of on-sale liquor licenses, I recommend that the form of question to be
submitted to the voters read as follows:
"Shall the City of St. Anthony be authorized to issue on-sale liquor
licenses to hotels and restaurants as provided in Minnesota
Statutes, Section 340A.661?"
Should the City Council determine to call for a special election on the question of
permitting Sunday on-sale liquor. I recommend that the form of question to be submitted to the
voters read as follows:
"Shall the City of St. Anthony be authorized to issue Sunday
on-sale liquor licenses as provided in Minnesota Statutes, Section
340A.504?"
JPG:pmh
3
