City Council Regular Meeting Minutes 10 <br /> June 8, 2004 <br /> Page 10 <br /> 1 <br /> 2 (h) The last municipalities, not to exceed five,where the applicant carried on <br /> 3 business immediately proceeding the date of the application and the <br /> 4 address from which such business wad conducted in those municipalities.- <br /> 5 (i) Written statement of permission from fee owner of property where <br /> 6 . transient sales are to be held. <br /> 7 <br /> 8 1130.04 Exemptions. This Section does not apply to persons engaged in the following <br /> 9 activities: <br /> 10 <br /> 11 (a) Selling personal property at wholesale to dealers in such property. <br /> 12 (b) Selling solely literature. <br /> 13 (c) Selling products of the farm or garden on the property on which the <br /> 14 products are grown and cultivated. A person claiming this exemption <br /> 15 must submit written-affidavit indicating that the products be sold were <br /> 16 grown in property where the sales are occurring. <br /> 17 (d) Calling upon householders in connection with regular route service for the <br /> 18 sale and delivery of perishable.daily necessities of life such as bakery <br /> 19 products.and dairy products. <br /> 20 (e) Calling upon households at the request of the householders. <br /> 21 <br /> 22 1130.05 Proof of Registration. Upon receipt of a complete registration, the Clerk will transmit <br /> 23 the same to the Chief of Police for Approval. Every registration must bear the written <br /> 24 approval of the Chief of Police to be valid. Within five days after such registration,the <br /> 25 City Clerk will provide the registrant with a written certificate showing proof of <br /> 26 signature. <br /> 27 <br /> 28 1130.06 Registration Not Transferable. No registration is transferable from one individual to <br /> 29 another. Each individual must be separately registered where more than one individual <br /> 30 is involved in the same type of activity even though associated with the same <br /> 31 organization. <br /> 32 <br /> 33 1130.07 Practices Prohibited. No peddler, solicitor or transient merchant is permitted to call <br /> 34 . attention to the business or merchandise by crying out,blowing a horn, ringing a bell, <br /> 35 or by any loud or unusual noise. No peddler, solicitor, or transient merchant is <br /> 36 permitted to harass, intimidate, abuse, or threaten a person or continue to offer <br /> 37 merchandise for sale to any person after being told not to do so by that person. <br /> 38 <br /> 39 1130.08 Duration of Registration. Each registration will be valid for a period specified and no <br /> 40 registration may extend beyond the 315`day of December of the year in which it is <br /> 41 granted. <br /> 42 <br /> 43 1130.09 Exclusion. Any person who wishes to exclude peddlers, solicitors or transient <br /> 44 merchants from his or her premises may place upon or near the usual entrance to the <br /> 45 premises a printed placard or sign bearing the following notice: <br /> 46 <br /> 47 "Peddlers and Solicitors Prohibited" <br />
